We are buying a property with a small strip that has 1/12
del diritto del concedente (gravata da enfiteusi)
It has a few olive trees on
After looking it up it looks like the ground is leased and relates to old Roman law.
Interested if anyone has come across this as well.

Enfiteusi is alive and well. There are two types, and if not temporary is unlimited in time. The holder of enfiteusi has obligation to the owner of the property, but the land is to all intents and purposes his.

I think(after more googling) it must be in perpetuity not temporary.
It is weird as it stated 8/12 owned and 1/12 gravata da enfiteusi.
This all adds the journey we are on and look forward to the "Rogito" at the Notary office soon.
As this is a very small part and on the edge it may be a shared harvest come the autumn.
Probably not though as it looks like this strip has been neglected, so we can tidy it and possible benifit ?

No you cant touch it. If its been abandoned for more than 20 years you can ask for the enfiteusi to be cancelled. otherwise you need to find the enfituente. It sounds like it might be already in decadenza so id ask the notaio.

Its has not been abandoned it has olive trees, just not pruned for a few years.
I think most importantly if payment should be made, has it? I dont know yet who it belongs to. As I said there appears a percentage will be fully owned by us on transfer, not sure how that works.
Hopefully Notary will clear it up.

It doesnt have to be a monetary payment, it can be in kind - in your case olives.
