New CSL do you need to be assessed??
 

Hi, haven't been on the forum for a while as we had to decline 3 job offers in Australia due to not being able to sell our house, and going on a 457 was we felt to risky as only a temp visa and having 4 children, this may though make us feel diffeently, my husband is a fire alarm tech/engineer, and a migration agent said this comes under an electronic equiptment trades person as he deals with electronic panles for fire alarm systems, doe this new CSL list mean if he can get another employer to sponsor him in Autralia he does not have to have his job asessed by tra or vetassess. the job offers he had before they did say if there is a change to our circumstances or the visa applications then let them know and they will still be there with a job offer, as they are desperate for my husbands trade ,

does this nes CSL mean that if you have a job offer, you dont have to pass an assessment and that it is a permanent visa ?
it is probably clear to some but havent been on for a while as was very upset that we could not go ahead with the job offers and have been unable to sell our property , but if this is a perm visa then we may be able to emigrate and leave our home on the market and know we have perm residency in Australia , and not worry about needing to find another employer if 1 didnt work out and face being deported because we couldnt find another 457 sponsor

The CSL merely facilitates quicker processing.

It does not change the requirements to be satisfied for the grant of a visa.

I applied for 175 under MODL back in Ocotber. My skill is on the CSL list. Anybody know if this will be automatically processed quicker - or will be it processed at the MODL rate and only new CSL applications fast tracked?

Nevermind I've just found the answer

This crisis has weakened the Australian economy, as reflected in the recent Mid Year Economic and Fiscal Outlook (MYEFO) forecasts. In response to these changes in circumstances, the minister has announced a more targeted approach to the 2008-09 skilled migration program. This announcement includes priority processing of employer sponsored, state and regional sponsored and business skills visas and the introduction of a CSL of occupations. People seeking to migrate to Australia who have skills or qualifications in one of the occupations on the CSL will be processed in a higher priority to those applicants who do not. This will include all applications that are on hand at the time of the announcement as well as any applications received in the future.

The 133,500 skilled migrants applying to work in Australia will now be required to have a job – sponsored by an employer or by a state government – before they arrive or meet a critical skills list, including medical, engineering and construction.

It may be worth mentioning that there is (so far as I know) already a Ministerial Direction in place for MODL and State Sponsored visa applications. The Direction in question (dated 14/05/2004) says that:

"The order of processing of applications for Business Sponsorship, Business Nomination, Approved Appointment and visas under the Skill Stream of the Migration Program should be:

- applications relating to the entry of a person whose occupation is listed on the MODL; and

- applications for State-specific and regional migration visa subclasses; then

- all other fully completed applications in the order in which they are received."

Close observers of visa processing times may have a view on whether the Skilled Processing Centre has been adhering to the existing Direction ...

I would hazard a guess that the new Direction is intended to simply give renewed emphasis to the need for the Department to attend to certain skilled visa applications before others. Added to the political imperative to be seen to be doing something of course.

By way of further background, this is the status of a Ministerial Direction:

"Directions are not legislation. They are policy instructions, albeit at the highest possible level.

Decision-makers have a clear duty to be familiar with and to consider all relevant policy in every case. Directions are at the top of the policy hierarchy because the Minister is required to table each direction before Parliament and because the Act imposes a duty on decision-makers to comply with directions.

A direction is binding on officers with functions and powers under the Act if the direction is about the performance of those functions or the exercise of those powers. It must be complied with (that is followed), however, in the context of exercising a legislative discretion. Ultimately, the decision-maker retains the discretion to balance all relevant factors, after considering any relevant direction/s or other policy documents, to arrive at their own decision. Any departures from policy, including departures from s499 directions should be discussed with the relevant policy area prior to a decision being made.

A direction comes into effect as soon as the Minister signs it, unless there is a specified commencement date. Policy owners are encouraged to take into account implementation issues associated with making or revoking a direction (eg whether overseas posts require immediate access to a direction, via LEGEND or other means; amendments are required to a related policy instruction; training is necessary, etc)."

Migration getting harder
 

Interesting article in the Brisbane courier mail today. It seems that getting a visa is going to get a whole lot harder from jan 1st. It goes on to say that migrants will now need job offers before migrating.

It may be journalism but what they are saying is a reality and has started to happen.
It basically means you will need to be sponsored by an employer, sponsored by a state or be on the critical skills list to avoid a lengthy wait the way I see it.

The changes will start from the 1st of January.

Senator Evans says the Government will fast track the processing of permanent migration visas where the skilled migrants are sponsored by an employer.

People applying to come to Australia without a sponsor will be given priority if they have an occupation on the government's list of skills in critical shortage
