visa 456 allowed to work?
Hi, my husband is an IT consultant and has a multiple-entry 456 visa. I'm wondering what kind of work is he allowed to take with this visa? If he gets offered a temporary position for about 5-6 weeks from a different company than the one that wrote a sponsor letter for his 456, can he start right away for this new offer or does he have to apply for a 457?
Are there limits in 456 other than the maximum 3-month per entry? Any advice is greatly appreciated, Regards Cherie |
Re: visa 456 allowed to work?
456 is only for short business trips, not for taking employment in Australia, as far as I know.
What conditions does the visa have? (look at the label or approval letter). |
Re: visa 456 allowed to work?
It says:
CLASS UC TEMP BUSINESS P170 SUB CLASS 456 CONDITIONS MIG.REGS.SCHED.8 8112 AUTH. FOR BUSINESS ACTIVITIES. I was also initially under the impression that 456 can't be used to work, but I read some forums and some stated that yes some types of work are allowed, which leaves me a bit confused now. Any inputs? Thanks in advance |

Thanks in advance The key clause is: "The holder must not engage in work in Australia that might otherwise be carried out by an Australian citizen or an Australian permanent resident" So short business trips, which may technically be considered "work" are normally ok. Taking up employment in Australia is not. The 456 does not allow one to start an Australian job in anticipation of a 457 or other visa. Out of interest, is he a British citizen - if so, then why is he looking for a 456 rather than the ETA equivalent? |
Re: visa 456 allowed to work?
Thanks for the clarification. It's all clear now.
And no he's not British; he already pockets his 456 and we thought if allowed he could take up the employment immediately while waiting for the 457 to get through. So I guess we'll wait for his 457 then.. |
