Could anyone tell me one you have got a STNI visa how long you have until you have to leave the country to move to Oz.

I know with a Skilled Ind 136 you have a year to validate and then another year etc. but because of the points change we only have 115 points and have been accepted by Vic for STNI, I know they prioritise the visa so you could have it within 6 months but when do you have to leave for good???

Same deal as a 136 visa, 12 months to validate then I think 2 out of the three years or even 3 out of 5 years cant quite remember, just know it is the same deal as the 136 visa, we are in the same boat as you just waiting for Vic STNI, have had a provisional nod pending TRA.

There is an obligation with STNI to spend your first two years in Australia in the sponsoring state. Otherwise the legalities are the same as with subclass 136.

However the sponsoring state will be anxious to have you living there sooner rather than later. There is always the possibility that DIMIA will introduce legislation to cancel STNI visas where holders have not abided by their obligations.

Hi Tracey

a quick question, did you put in for 136 and then get picked up by Vic and offered STNI under skill matching etc?

Hi Jeremy,

In that case, is it possible for an STNI visa holder to take a 2 years off (after the first entry) to some other country and then return back to OZ after say 2 years or so. Please let me know whether this VISA would be cancelled by DIMIA at any chance.

Legislation could easily be introduced to do that. It's already been done for the RSMS visa.

But will it affect those STNI visa holders already validated their visa and now living out of Australia and planning to go back after 1 year or so..,

If the Minister wanted, it certainly could do.
The RSMS cancellation provisions were not restricted to visas granted after a particular date.

People should only apply for STNI unless they have a genuine commitment to live in the sponsoring state if nominated.
