Hi, do you know if there are restrictions on emmigrating to Australia if you have previous convictions? my husband is a bricklayer and we'd love to move out there but he has spent convictions from over 10 years ago. thanks nadine:)

Australian authorities are very strict about any person trying to enter Australia with previous criminal convictions. It shouldnt matter to them whether it was 5 years ago, 10 or 20. The fact he has a criminal past will go against him.

The best advice i can give you is just be honest on your application, and provide the necessary documentation meticulously. Dont miss anything out as this automatically goes against you.

No convictions are "spent" for immigration purposes. Whether he will have a chance or not will depend on lots of things such as type of offence, length of time since last conviction, whether he served a prison sentence etc. Pollyanna may be along to give you some better advice - or you could try PM'ing her with more detailed info. She is very helpful and will give you good advice. Alternatively try asking one of the agents "George Lombard" or "Alan Collett" - they are also very helpful.

As stated, it depends on what the conviction was for, when it was, time served in prison, etc. If it's a minor charge from years ago with no time served then it shouldn't cause any problem. If it's more serious, recent and time served it may be a little more difficult.

Also as stated, be 100% honest on your application as surely it will show up on his police clearance certificate.
