Default regarding transitional arrangement for overseas students

hi

this is regarding new transitional arrangements for overseas students. allowing students enroled before march 2003. to apply for pr under the old rules until april 2004.

my friend is doing two years of masters course in australia.

in november 2003 he will finish his one year of study work.

so can he apply for pr based on his one year study...

or he has to complete his two year degree...

he can be awarded graduate certificate or graduate diploma after one year of study.

please clarify this doubt.

Yes, this is quite a common practice among international students to apply for PR after earning one year long graduate diploma. There is no need to apply for a Graduate Skilled Temporary visa, as your friend's student visa will preserve his status.

hi

one more thing is that is graduat certiificate is valid for application.
is it possible to get 5 points for that.

my friend has three years of work experiance in his nominated filed. so he can claim 5 points..

also his course work is of two years.

but in this november he will be completing his one year of study.

so any suggestion pleaseee.

Usually in one year a person can complete a post graduate diploma. (A certificate is simply a semester). If it is an IT degree, you need at least a post graduate diploma to get skills assessment from ACS, unless you can get any other skills assessment on the basis of previous work experience/ undergarduate degree/ any reasonable test. If your friend has reasonable job experience in last six months or last 12 months (basic experience), he can appply in offshore category.

Well, it was a common practice for IT students anyway.

Current IT post-graduate students need to enrol in a course no shorter than 3 semesters to qualify for an ACS skills assessment which waives work experience requirements. This is different and independent of the new DIMIA regulations concerning overseas onshore students requiring at least 2 years of study in Australia, notwithstanding the recently announced grace period.

hi

my friend is a civil engineer. and he is doing masters in related field only.

he will be requirred to asses his civil engineering degree.

but can he apply for pr after his one year of study period. based on the fact that he has three years of work expaeriance in last four years time.

so basically masters is for waiving of that immidiate work experinace requirement for nominated skill.

is it possible??

If your friend's course is 2 years long, he cannot qualify for skilled migration after 1 year's study, unless he gets a (post-)graduate diploma/certificate after one year's study and meet the requirement as spelt out in the transitional arrangement for overseas students recently.

Read the Skilled Migration Booklet for more details on the basic requirements.

thanks for reply.

yup my friend will complete his post gradute certificate requirement in november.

basically he is doing two years duration masters course.

so if he get that certificate can he apply for pr after november.

or else he will be requirred to complete his pg diploma.

I guess yes. Further, your friend can apply for Skills Assessment from IEAust right now, on the basis of Bachelor's degree. This will save time waiting for skills assessment after completion of Garduate certificate.

I thought "3 semesters" apply to those who had done non-IT
undergraduate
degree and now doing Masters (conversion masters).

"2.1.4 As a guide, to meet the criteria a Graduate Diploma or Masters
degree which is undergraduate in content and
_is_taken_after_a_qualification_other_
than_an_IT_degree_or_equivalent_, would need to be a minimum of three
semesters equivalent full-time study"

I thought that those had done IT undergraduate degrees and now doing
Masters in IT fall into Section 2.1.5, which states:
"2.1.5 As a guide, a major in IT for a Post Graduate Diploma or higher
degree qualification
_which_follows_a_degree-level_qualification_with_a_major_in_IT_ must
have an IT content of at least one third, all of which must be at post
graduate level."

2.1.5 does not seem to impose any minimum time requirement like 2.1.4
does.
