Q on 186 Visa
Hi! I'm new to this.
I have a question re. the 186 Visa. On the governmental website, under “Expression of Interest”, it states:
“If you do not have an employer who will nominate you, you can submit an Expression of Interest (EOI) through SkillSelect. Prospective employers and state and territory governments can then view your details and decide whether to nominate you for skilled migration.”
But when we login to SkillSelect EOI, it states: “The EOI for this subclass is able to be completed.” When I click on “Apply Visa”, I get a pop up window where it states: “In order to lodge an application for this visa type, the employer must have already begun their nomination application. You will need their Transaction Reference Number (TRN) to continue.”
Then we are asked: “Do you wish to start lodging a visa application for this visa now?” YES or NO.
How do we proceed? Can we proceed? Thanking you in advance.

My question then is can you make an EOI and submit, in hopes that an employer will see the EOI and offer the applicant employment?
Because when I review the Home Affairs webpage and look at 186 specifically (the link ends with this: /trav/visa-1/186-), it is stated that you can apply for this visa through an EOI. Is that not possible? My husband doesn't have enough points (he's 45) and I fancy OZ for our family.

I think you are confused. Yes you apply for the 186 through the EOI , but you need to have an eligible sponsor before you can apply. An EOI is just like putting a notice up on the board at Tesco saying "job wanted". It is not an invitation to apply for the visa.

At 45 he is no longer eligible to apply for direct entry 186 anyway.
I’m afraid it doesn’t look like you will be migrating to Australia unless you are younger and have an occupation on the list, or perhaps are business owners or people with several million dollars to invest.

At 45 he is no longer eligible to apply for direct entry 186 anyway.

Sorry about delayed response. We got the news yesterday that yes, my husband will be relocating to OZ with the same company he's been with for 11 years, and will have sponsorship. Because the the time difference, we cannot speak with the HR Manager until tomorrow. We were told my husband's visa will take two months so we should plan on 1 May latest to be in OZ. What visa can be approved in such a short time? Could it be a 457? My husband is a highly skilled Application/Process Engineer with 11+ years at his current international company and three years before that at an inter'l pharmaceutical co. He's got two Masters of Engineering degrees. We have mixed Danish, Icelandic & Canadian passports. Now if it's a temp visa, will our eldest son be able to follow us and attend UNI? He's 16 and should complete his studies by 2020 and thereafter enter UNI. We're concerned our accepting a temp visa will affect his studies.�
If it's 457, can we after two years working for the same company transition to PR? It's a big move for us and our three children, so we want to know if it's going to get us to OZ permanently. We were told I get a work permit too.
Any ideas? We want to relocate to OZ, so we're pretty sure we'll accept this lateral move.

I was reading more about the 186. If my husband gets the 457, can he, when he is 47 (in 2 yrs time), apply for the 186 under the Temporary Residence Transition stream? It's our eldest son we're most concerned with because if we get the PR as 186 by 2020 our son will not need to return to Copenhagen alone to do UNI. He'll be able to continue living with us in OZ.

No the cut off for 186 is 45. The only visa they can be talking about is a 457 which will be phased out in a few weeks anyway. This is temporary and cannot lead to permanent if over 45.
I know it seems silly to penalise older people who have a wealth of experience to bring but the hard facts are they will be paying less into the system over their lifetime.

We were told it was temporary but we would get permanent after a couple of years? If the employer lodges the visa application ASAP, does that help?

It never was as straightforward as they have made it sound to you above and is much harder now. I saw an agent post that they would not take any new 457 applications after the end of February anyway. I think this could only ever be a temporary move for you.

I do not know about the dates, other than I just saw a migration agent post about no more 457 application after end February.

Nobody over 45 can apply for a skilled PR visa. The new visa replacement for the 457 is temporary only and will not lead to PR. Ever.
