Process of cancelling Spouse visa
Was wondering if anyone can help me with the process of cancelling visa.
Hubby and I have gone seperate ways, I am back in UK and he said he has sent a letter to cancel visa.
What happens now?

Sorry to hear of your problems.
Have you used an agent? Ask them or why don't you ask Alan Collett, he's pretty excellent. Did you actually have PR or were you in the middle of your application?

Hiya Jo,
Used Alan's agency to get visa yes. Was on Temp spouse visa with a year still left to go on it... so as I said I am not sure what goes from here. Letter has apparently been sent, but I dont see it being that cut and dried?!?!?!?!?

i am sorry to read what has happened to you and your son, i followed the threads as i am now applying for a partner (de facto) visa.
about your question. are you sure you have to cancel it as you where still in the stage of temporay. i would think that a letter to dimia stating the end of the relationship that led to the grant of your visa would be enough, like that you will just never enter stage two (apply for permanent) and your temp visa will run out. i might be wrong, but it was just an idea.

yea that is possible, but as I said I am so not sure and there is not really alot of info about it, or I am not looking right lol

So sorry to hear of the situation you find yourself in at the moment . In your posts you didnt say if you wanted to stay in Australia or not ??????? I dont think your Ex can cancell your Visa . I do think it would be a good idea to talk to an agent It may be possible to contact DIMA and inform them of your current situation It may not necessary be the case that just because you have parted company that your visa will be cancelled Did you have a chat to any one at an Immigation Support Centre before you left These people will give you very good information > Hang in there , you have put in all the hard yards , But I would get some professional advice fairly quickly Good Luck Keep us informed Gerard

Your spouse can only intimate to DIMIA that the relationship has ended and when such intimation is received by DIMIA, they would send out a letter to you about the circumstances which may allow you to continue to stay. In your case, they would be - if there has been domestic violence or if you have been given joint custody of the child, etc.
You will also be given some time (about 35 days) to reply to the letter. So make sure you are able to get this letter (as you have moved out of the country now).
Good luck.

The general rule is that if a relationship ends during the temp spouse
period, then the permanent application gets refused and the temp
spouse visa will then cease to have effect.
There are exceptions to this in cases where:
a. the Australian spouse has died
b. there has been domestic violence; or
c. there is joint custody of a child
but there are specific conditions and processes that apply to all of
these. You should perhaps contact an experienced professional
straight away to discuss your options if you want to stay in, or
return to, Australia.
