Previous Criminal Conviction Ausie Visa threat!!!!

Unhappy Previous Criminal Conviction Ausie Visa threat!!!!

We are currently trying to move to Adelaide to be with family, John has a previous conviction from which he spent time in prison.
The UK now see his conviction as 'spent' as it was 13 years ago and the sentence was minimal however as the sentence was longer than a 12 months conviction the Australian authorities frown heavily! Had he received only 9 months the issue that we face would not be so great.

We have been sold aloud of crap from a number of different agents trying to fleece more money out of us!!!

WERE LOOKING TO HEAR FROM ANYONE WHO HAS HAD THE SAME ISSUES

* HAVE YOU PROCESSED A VISA AND BEEN ACCEPTED HAVING SPENT TIME IN PRISON?

* HAVE YOU PROCESSED A VISA AND BEEN DECLINED BECAUSE YOU WERE IN PRISON PREVIOUSLY?

* ARE YOU CURRENTLY GOING THROUGH THE APEAL PROCESS?

* HAVE YOU GOT A GREAT AGENT WHO HELPED ON ALL OF THE ABOVE?

We are looking for advice and assistance in the hope that we can offer the same to you in return. It is always an advantage to hear/see things from different scenarios and even better to find possibly friendship for our new lives down under.

(Please do not be put off by the Prison thing... we are a normal, down to earth family just looking for a fresh start and a better way of life)

Best advice is to engage a registered migration agent with experience of conviction issues. George Lombard might be a good one to try - look for his posts on here and you'll find his contact details in his signature.

I know of a migration agent who obtained a visa for a client who had been convicted for manslaughter. Wasn't easy but he did it! If I can dig out the name I will, but i think his name was Johann Kronnanberg or something like that, based in London. This was a few years back but he can do an initial assessment over the 'phone to see if it's viable, if it's not he'll tell you.

George Lombard in Sydney has experience with character issues. But you would help yourselves if you start out from a certain basis - that in most countries, prison sentences in excess of 12 months are usually not imposed for "minimal" offences.

Out of interest, do DIAC frown equally on all offences carrying a >12 month prison sentence? E.g. are they more forgiving for (say) fraud as compared to drugs offences, or theft compared to violent crime?

Each case is reviewed on its own merits by the character assessment unit, so I don't think it's so much the offence as the applicant.

They usually look at the bigger picture, that's why getting an agent on the case as good as they know the stuff that will put the conviction into context with the rest of your details - stuff toput in from a character reference point of view, etc.
