PR and divorce

Default PR and divorce

I am in Australia as a PR already for one year. My wife asks for the divorce. We have a child. I have few questions.

1. After the divorce is finalized, obviously I have to inform DIMA. Is there a specific form or just a letter is sufficient ?
2. What is going to happen most likely. I have a job, I want to have contact with my child, I am paying CSA ?
3. Is it so tricky that I need agent ?

Sorry people, but can somebody please tell me, if I divorce and already holding PR (for more then 2 years), do I have to inform DIMA ?
If so, is there a form or just a standard letter is enough ?
On there web site it just says about obligations:"Spouse permanent visa (subclass 100)

Adhere to visa conditions and comply with all Australian laws. "

No

But from your previous posts I am quite confused as to your status, when you got your Temp visa, when you got your PR and when your marriage broke down. Therefore, you really need to outline your exact circumstances to get proper advice, otherwise it's meaningless.

My wife left me a half year after the PR is granted, with our child (at the time 1,5 half years old). The divorce is not yet finalized. Officially we will be more then a 5 years married before the divorce. I certified my PR in the gray region, I would call it, when my wife left me but it was not clear that it is for good.
I am paying CSA, visiting my child, etc.
Any advices and/or suggestions what maybe of concern are very welcomed !!!!

In that case then I think you would be best getting professional advice, as DIAC may see your PR appliaction as fraudulent - in that you weren't still co-habiting with your wife at the time of your PR application. Even though you didn't know that the split was for good - I would imagine they would have expected you to wait until things were resolved before putting in your application.

No, I think you misunderstood. I received my PR genuinely, and after 6 months after that my wife decided to leave me. As you may guess application is made even few months before I received it. Not to mention, that my wife again genuinely participated in giving evidence and statements about our relationship.


Sorry, Dorothy, but some people like triple check . I hope you understand, it is very important.

If you were still a couple when you got PR then you don't have to inform DIAC and your PR won't be cancelled.

If he got his PR visa offshore and broke up before it was validated then he may well still have a problem.
