With cancer they generally look for a three year clear period as a minimum but there may be exceptions in particular cases. I would suggest someone in this situation use an agent experienced in medical matters, eg Peter Bollard in Sydney.

Probably OK.

It is possble to undertake a medical examination for migration and know the result before applying for a visa.
Check with your Australian mission and a Panel Doctor.

Bear in mind that medical examinations are valid for only 12 months and another medical might be required during the visa processing.

This may be too specific an issue for anyone to be able to help with, but this thread is SO spot on for me at the moment, I thought it might be worth a try: I've been married to an Aussie for 13 years & have 3 children (with him!) who are all Aus citizens, although we've always lived in UK. We are now hoping to move to Melbourne in the New Year. I got all my papers ready to apply for my spouse's visa a couple of months ago but we decided to delay it until we got back from our "where do we want to live" reccie - something about balancing the credit cards!! Anyway, getting it is just a formality - right?!?
Anyway, I've recently found a lump, went for a mammogram and have been recalled for more tests. Setting aside the bigger, scary picture - would a positive diagnosis mean that the move to Oz is off... or at least postponed indefinitely?

Hubbie says they can't expect him to have to leave me behind if he and the children "move home", but I'm sure medical costs etc will come into it - having a medical condition that requires expensive and possibly on-going treatment would surely mean failing the medical, and whatever kind of visa you are going for, you won't get it if you fail your medical......?

Anyone able to offer any advice? Thanks

Hi, our panel doctor advised that we get some additional info from our GP and the hospital and take it to him to return with the medicals. We did this and the panel doctor seemed to think that everything was fine and we should pass. The meds are on their way so hopefully we'll have our visas soon.

Also my bro in law emigrated out to Oz 2 years ago, he'd had a tumour removed from his brain and had to wait 5 years for his all clear but he applied, he was accepted, and he is now living on the sunshine coast.

I would contact Peter Bollard, as in Jeremy's reply just above yours on this thread - he is recommended a lot for health issues. I have also heard that they may be slightly more lenient on medical issues for spouse visas, though you still may have to do a health undertaking, and see doctors when you get here.

Thanks Pollyana - for some reason I couldn't make the link on the thread work, but I've found him via Google... will definitely get in touch with him once I know what's what! Nothing worse than worrying about nothing - and that includes the visa!!!!!

If want a dangerous over-simplification the 'health' criterion comes down to a question of whether a medical condition will present a public health risk or involve e the use of scarce resources or cost the Australian taxpayer too much for treatment, medicines or other services; if the medical condition follows its usual course. The good thing is that DIMIA MUST accept the opinion of a MOC (Medical Officer of the Commonwealth) as conclusive. The bad thing is that MOCs are expected to be accountants as well as medicos. In cases where there is a medical issue it pays to obtain specialist medical opinions before undertaking a medical examination. These opinions must follow a specified format to be given due weight; they have to address the specific legal tests prescribed in the legislation.
