New 457 regulations 90 days notice instead of 28
 

I see that the new 457 regulations that are now law include 90 days to find new employment as against 28.

My daughter has a Visa class/subclass UC 457
Visa description TEMPORARY RESIDENT
Visa applicant Secondary

Basically she is in a defacto relationship with her fiancee .

Her fiancee needs to leave australia to start work in the USA but her US Visa is still being processed.

Does this new ruling mean she gets 90 days to leave instead of 28 once her boyfriend leaves OZ ?

Once he leaves his job they have 90 days to leave his how I understand it.
Its not 90 days from when he leaves the country, it'll be 90 days from when his employment ceases.

Sorry i meant once he leaves his job to return to USA.
My daughter is waiting for her US Visa and it is extremely stressful to say the least..

It was 28 days from when the visa is cancelled. So I assume this is now 90. I say this because someone I know went back to the UK, and tried claiming back his superannuation. He couldn't get it for a while as his Aus employer even though made him redundant hadn't actually cancelled the 457 Visa.
