Leaving Australia after applying for PR
 

I currently hold student visa valid till March 15' 2004. I will be
applying for Permanent Residency (PR) by September end.I m not allowed
to leave Australia after applying for PR. But as I hold student visa
which permits me multiple travel, can I travel abroad after applying
for PR?

Hi Shalabh, Peter,

The rule is that the processing of an onshore graduate pr visa stops while
the applicant is offshore. This is because applicants need to be onshore at
time of grant. But when you return the processing can recommence.

To add to what George has said, there may be issues if your absence
from Australia is anything other than short term. There are also a
number of technical issues involving bridging visas that you really
need some professional advice about.

If you are planning to be offshore for some time it may be more
appropriate to apply for an offshore visa, depending on circumstances
- but again you should get some good professional advice.

Please consider this an opinion and not absolute truth

I would suggest that you contact DIMIA for parole authorization and requirements, because if you leave without informing them and your PR is granted, it may be cancelled because your being out of the country may be considered abandonment of your PR status when the PR is granted while you're away.

1. An onshore skilled visa (presuming that's what the original poster applied for) cannot be granted when the applicant is overseas.

2. If you're referring to the concept used in the USA (for green card holders there) or previously used in Canada, then it's not applicable in Australia. Australia's method of determining one's eligibility to retain permanent residence when returning from abroad is generally more objective.
