Default HELP: Changed on MODL 15/05/08

Hi there I applied for ACS assessment on 1 May 08 and received their acknowledgement on 28 May 08. ACS states that I am suitable under an ASCO Code 2231-79. I had been working as an ICT Lecturer with 5yrs and 5mths of experience which I was accessed upon.

Was almost going to lodge my visa appln under the General Skilled Independent PR visa till I noticed a changed on the MODL listing of job on demand which was updated on 17 May 08 at URL: http://www.immi.gov.au/skilled/gener...nd.htm#compnec

So what happened now was that the Aust Immig had a new specific list of IT people they want under the ASCO Code 2231-79(nec), where 'nec' means no where classified. My working experience as an ICT Lecturer does not fall under the new MODL list anymore and they stated on the webpage those not on the list will not be awarded MODL points.

So sad and shocked over these surprises. I blamed myself for not doing enough of my homework. Any kind hearts out there can help or advice me what to do? Should I carry on lodging my visa appln and try it out or apply another temporary working visa or .... Thanks alot in advance

Does your assessment letter state that you meet the requirements for your specialisation?

How many points short are you without the MODL points? Can you make up the shortfall with the extra IETLS points or by getting state sponsorship?

Hi Schwuk, thanks for ur reply. The assessment letter states:
-For the purpose of your appln you have as of Sept 2006 satisified the reqm of the ACS PIM 2, Group A.
-Your skills have been assessed to be suitable for migration under 2231-79 of the ASCO Code, being the skilled occupation indicated that you intend to nominate in a General Skilled Migration appplication.

Without the MODL, I had only 115 points (60 points from SOL, 25 points from IELTS if manage to get 7.0 average). Was thinking of State sponsor (extra 10 points) but I intend to go to Tasmania where down there IT people were not on the state job shortage list. Still checking for other options to fill up another 5 points.

Did you mean 2007? The ACS letter is only valid for one year.

I've re-read your original post and wanted to clarify something: did you think you were going to receive MODL points before the list was changed?

From your description of the results letter it doesn't sound like you were given any specialisation from ACS, and 2231-79 - Computer Professional not elsewhere classified (nec) - without a specialisation was not on the MODL before.

From the MODL itself:

Skills assessments provided to successful applicants will state:

* the ASCO Code for Computer Professional not elswhere classified (nec) with the specialisation stated in brackets - for example, 2231-79 (SAP)
and
* the statement: 'Based on the provided certified documentation, it is my opinion that the applicant has 12 months experience in (name of specialisation, for example, SAP)'.

Note: If you have a skills assessment which only states the ASCO Code for 'Computer Professional nec 2231-79', you are not eligible to be awarded MODL points. A new assessment with the above information will be required if you wish to claim MODL points.

similarly agreeing to what schwuk said, reading what you quoted from the letter, not that i've received one yet, but from other people who were claiming MODL, it doesn't sound like you were given any MODL points..? did you specifically asked for MODL in your app?

We were awarded MODL points once our application was lodged. The skills assessment is just to assess your skills NOT to award the MODL points, that is done later when your application is processed.
If you lodge your application when your occupation is on the MODL, then it is removed you still get the points.

If you're assigned the ASCO code 2231-79 by ACS then you have to be assessed as specialising in an area listed on the MODL to receive the points (see my quote from the MODL above). No specialisation, no points.

Also it seems that ACS only recognise specialisations that are on the MODL list at the time of the assessment. This means that with the recently revised list some people are considering being re-assessed because their specialisation has been added, but was not recognised by the ACS when they were originally assessed.

ASCO code 2231-79 is still on the MODL so you will get the extra points

Yes, Tawkins1 this is correct. 2231-79 is only MODL if ACS assesses you as being in a MODL specialisation, you can be 2231-79 and not MODL.

I agree that it doesnt sound like the OP was MODL'd in the first place.

Hi there, thanks for all your comments and tips. I read from some webbies and Schwup is right, I am not suitable for MODL points, only 60 points for the SOL listings. I am considering the 176 Skilled Sponsored visa now with a min score of 100. As I am going to Tasmania, I am sending my appln for Tassie State Sponsorship so that I can go ahead with the 176 visa. Hope I can be awarded the sponsorship soon. Thanks all
