Hi,
Can anyone help.
My partner and I want to emigrate to Australia next year, we are off to Oz for a 3 week holiday at Christmas to see if my partner likes the country.
I lived and worked in Oz when I was 16 for 1 year and have always wanted to emigrate.
My problem is I have two children, the youngest is my partners daughter but my son who is 11 isn't.
Luckily for for me both my present partner and the father of my son both have the same surname so both my children's surnames are the same (White).
My partner and I are not married so my surname is different, we will marry if it makes things easier.
My sons father's name his on his birth cert, he has had no contact at all with his father for the past 8 years, he has never given me a penny for his child and we was'nt ever married so his father has no parental rights.
What I would like to find out is would my partner have to adopt my son, if so do I need to contact his father or would I as his mother be able to apply for visa's etc or would this be a problem when we have to supply birth certs etc.????

But before you worry about this - are you even eligible to migrate in the first place? Not everyone is, so no point worrying about child custody requirements if you don't have the necessary employment/education skills.
