Default HECS Debt

We have started the process of Partner Migration.
Does my HECS debt from university count as a debt to the Commonwealth of Australia?
I just realised in the booklet it says you cant apply if you have a debt to to commonwealth, but surely most people have HECS debts and still can apply?
ERK!

Any advice received gratefully!

Your HECS debt is not outstanding or overdue therefore it won't be a problem. I think they are referring to unpaid fines etc. For detail of your HECS debt contact the ATO.

by the way are we eligible for HECS / PELS the moment we land in Australia as a PR?

I've answered this before. The answer is 'yes'.

However, a permanent resident loses his/her eligibility for HECS/PELS the moment he/she qualifies for Australian citizenship but refuses to naturalize as a citizen.
