Filipino wife
Hi everybody, I'm new here and would like some help please if you can. I am
going though hell and my wife too. DIMIA in Manila refused her a visa 309 to
come to Aus and live with me, and NZIS in Manila also refused a Tourist Visa
to visit NZ over Xmas with my family ( I live in Aus but from NZ) They both
said they don't believe we are genuine. I say that's bullshit and they got
it totally wrong. in other words they are calling us liars, does the
marriage mean nothing, my wife's family must be devastated their daughter
and them have done the right things to see her off and married the proper
way and now its back fired on us all. It makes me sick and I hate them all
for what they have done to us, they have no compassion. we are the most
genuine couple and they can't see it. The system stinks and has let us down.
We did everything they asked for and still we the wife did not meet their
requirements yet I know of others in the same boat who just breeze though,
something is wrong and unjust towards us.

Manila do have an evil reputation for doing this. You do need to see
a MARA registered migrattion agent who has had experience in this
area. When the decision went against you, you has her sponsor has a
right of appeal to the Migration Review Tribunal (MRT). You would
have had a time limit in which to appeal. If you are still within
that time limit then I would see an agent who will lodge an appeal for
you, and then help you gather the evidence for the appeal, including
getting access to the contents of your wife's immigration file from
DIMIA in Manila through the Freedom of Information Act. Once you know
the grounds that are being used by DIMIA to refuse to grant your visa
you and your agent can prepare a case for the MRT.
Note that the MRT often overturn decisions made by DIMIA. The agent
we work through in Perth has won 36 out of 37 cases to November last
year. So you do have a good chance.
If the time limit has already run out to Appeal, then you may have to
lodge another application first.

Hi Peter,
I agree with Jerry that you should be exploring an appeal to the MRT, and
that a registered agent would be of some assistance. Doing an MRT appeal
through an agent who isn't in your locality is a nightmare and therefore I
would recommend you contact a local Migrant Resource Centre or contact
www.iarc.asn.au to find one close to you.
Jerry's statistics probably don't show the whole situation. The overall
success rate in the MRT is 60% but there are lots of cases where people were
represented and didn't win. You can browse the MRT decisions database at
www.mrt.gov.au .

possible appeal or reapplication, so I won't repeat that here other than
to say it's necessary.
The other thing you can do to indirectly help your case is (if you're
eligible) become an Australian citizen, if you've not done so already.

applied though FOI to see the file so will see what happens after I read

I think that so many people have exploited the mail-order bride
route - many having been burned by the "wife" leaving as soon as
the PR visa is granted, that a lot of suspicion surrounds this
strange marital arrangement.
The government is clearly right in keeping the lid on the dubous
business, so you really shouldn't be surprised that you are
being treated in this way. Even if you win the battle with the
authorities, you still face the stares and dissaproving looks
from fellow Australians who see your behaviour as improper.

Obviously, it is improper to stereotype Filipinos and Asians about marriage or anything for that matter. Many of us are just as smart and sensitive as many Australians are. I take offense.
However, not that I discriminate fellow Asians, there indeed is a tendency for third world citizens to be abusive of visa schemes in order to get out of their countries.
This reply of course is not in any way specific to the Thames couple case.
Peter, try to figure out why they keep denying your application. They must have told you the reason/s why. Then, maybe you should seek for consultant's professional help.
