Default Business Visitor Condition

Hi,


We have been trying to understand better the business visitor condition (8115).


From what we can see around the intent of the condition and also the exact wording of the condition, it does not preclude freelance work that is for overseas customers and that is contracted overseas.

Has anyone been around this loop?

I would run this past a migration agent before undertaking any work as Australia can take a very broad definition of work

From DIBP policy:

Online work

Applicants wishing to work online (for example, stockbroker wanting to check emails, share prices etc. online) may apply for a Tourist stream visa if the online work is incidental to a holiday. If the applicant is holidaying in Australia for a short period, and just wishes to keep on top of work back home (that is, the online work is incidental to their trip), this is not of concern in terms of condition 8101.

An applicant who wishes to continue their overseas work online, basically full-time may be of concern in terms of the genuine temporary stay requirement and should be considered carefully. But generally, such persons are also unlikely to be in breach of condition 8101 and are unlikely to be taking a job away from an Australian.

I did some googling as well. I was under the impression though that agents were asked to provide their details in a signature - or has that changed now?

The bold is incredibly annoying, I agree, and needless.

Unless I am much mistaken, he is an agent who used to post here as Westly, years ago. He had his details in his signature then, and he should have them now. I may no longer be a mod, but I know that rule hasn't changed.

Can you please stop giving this advice. It's incorrect and unhelpful. Certainly give the DIBP website if it hasn't already been suggested but don't tell people to contact them. They won't be able to help.

Are you an agent or do you have experience with Australian visas? Suddenly appeari g and giving dodgy advice with no back up info is the route to being banned.
