Hi All

I am a Oracle Database Administrator with 58 Months of experience in IT industry (47 Months as oracle DBA and 11 Months as front end programmer Visual C++).

I have done my Bachelor of Technology in Electronics and communication.
My query is for which Visa i am eligible 175 or 176 as i do not see my profession listed in SOL schecule 1 , but it's present in SOL schedule 2 (262111 ).

Secondly how do i compare my education with Australian Qualifications Framework (AQF) standards. Which decides if i come under group A or group B (As in PASA Guidelines).

SOL Schedule 2 means you must obtain state sponsorship and if successful, apply for a 176 visa. Research which states offer sponsorship for your occupation and what additional requirements are, and if they still have places remaining in this year's programme. If sponsorship quota is closed, then you will only be able to start your process in summer 2012, but keep in mind that there are heavy changes planned in the migration programme and that may affect your eligibility for any visa in general.

Also, nobody can tell you what your education compares to, what group you are in or if you are eligible at all, because you can not supply enough details for that on the public forum and nobody here is qualified to provide such advice anyway. Call an agent and expect to pay a small fee for this.

Thanks. Ok i'll do my research. Just wanted to add that my sister is already a PR holder. Could she be of any help in this?

No. Except may be you can use her home address to receive letters from ACS, if you do not trust mail in your high risk country.

Hi Ankur,

you will have to obtain state sponsorship if your occupation is in schedule 2. If you find a state which has your occupation listed, the next step would be to get your skills assessment through ACS. When you receive a positive response, in the letter you will see if you are in Group A or B. Please contact a registered migration agent in case you need more clarification on stuff. An obviously you need to write IELTS and receive 7 in each band before you apply for state sponsorship.

Here's what i found in eligibility requirements for 176 clause

" State or Territory Government Nomination – Eligibility
or
Eligible Relative Sponsorship – Eligibility "

in case of second option my sister can sponsor me. Please clarify.
Am i missing something?

As far as I'm aware you no longer get points for being sponsored by a relative for a 176.

Agreed no points. But i need not get sponsored from a state. Which i believe bounds me to work in that state for 2 years. So if i get sponsored from a relative i get the freedom to work anywhere in Australia. (Assuming pass the point test without state sponsorship)

If you pass the points test without state sponsorship, then, assuming the rest of the eligibility criteria are met, you can apply on your own. The 175 visa is independent - why do you think you need relative sponsorship?

Beacuse My occupation (DBA 262111) is in SOL shedule 2. Which i believe requires a sponsor. Am i right?

Ankur, the reality is that you can only apply if there's a state prepared to sponsor a DBA. NJ was right about the family sponsor not being much help, except for those on Schedule 1 who have reason to believe they may need appeal rights to the MRT. At the moment even if there are states prepared to sponsor a DBA you would be gambling that the occupation won't be frozen in their lists, for example SA has you at "medium availability" but will it be the same situation when you've completed your skills assessment?

Hi Guys, I have a question for my younger brother who I guess is already quite late in his immigration application to DIAC. His age is 32 (30 points), 5 years working experience outside AU (10 points), A recognized overseas MBA (15 points), IELTS results are awaited where he will surely score beyond 6's but not sure about all 7's. He has been recently assessed by VETASSESS as Office Manager 512111 (SOL Schedule 2).

This means he is short of 10 points; if he scores all 7's he gets the required 10 points - can he then apply directly under visa subclass 175 without acquiring any state/territory regional sponsorship? (as his designated occupation is not in SOL Schedule 1).

Or the only choice is to get State/Territory regional sponsorship and apply under visa subclass 475 - whatever the score of English test is?

A sister of his wife is an Australian citizen. Will that somehow help?

Visa subclass can't be considered as that will yield him only 5 points; am I right?

If the occupation is not on schedule one and is only on schedule two, he needs state sponsorship.
