Divorce after granting PR-Experts can you plz help?!
 
H there,
I'm new to this forum and wondering if the experts here could give me a relief as i'm very concerned about my situation at the moment.

I got married in 2001 overseas. in 2005 we applied for skilled migrant visa(subclass 136) & granted our PR (my Ex-hubby was applicant and me as a spouse) in 2007 and made the innitial entry.

After almost 1 year and half in Australia we decided to divorce as the things did not work out between us and already lodged a joint application.

My big concern is" Will i loose my PR if i get divorce"? Given the fact that we have been living together as a husband and wife for 8 years?

No, you won't. You probably would have done if you had only just been granted the visa and had not yet validated it (i.e. you ceased to be a couple, whether married or not, before validation as that is considered a change of circumstances) but you will be fine in your circumstances.

You have your own permanent residency visa, so you can live in Australia without your husband. A divorce will not affect your visa.

If you want expert advice you will need to speak to a MARA registered migration agent who is up to date with current migration law. What you will get here is experience of others who have migrated to Australia or are in the process.

However, as Louie says, you have your own PR and divorce will not affect it.

Once granted & validated PR is personal property of the individual...hence nothing to worry about...if still in doubt call DIAC and find it out with them..

Just to echo the others once you've receive PR and validated it what happens in your relationship makes no difference to DIAC.

So if you get divorced you will still have PR on your own.
