DIAC Dilemma with Form1100
 
Dear XXXXXX

I am writing to you regarding your General Skilled Migration (GSM) 475 visa application lodged on 19/08/2009.

In your visa application you claimed to be nominated by a state or territory government. To date, a state or territory approved nomination has either not been provided or has not been accepted by this department. Until this occurs, your visa application is not eligible to be considered as state or territory nominated for the purposes of priority processing, and will be considered in a lower priority group. [Form 1100 has been sent by Territory 15-12-09 by mail to DIAC and kept me CC. So I have a copy of Form1100.I have chased them for it from 24-08-09. If its not been accepted I assume it means refusal finally]

A nomination from a state or territory government is now required. You are encouraged to contact the state or territory government agency nominating your application to determine if you still meet their criteria or if they require any further information from you. Further information about State Migration Plans (SMP), the nomination process, as well as contact details for state and territory nominating agencies is available at
http://www.immi.gov.au/skilled/gener...tate-plans.htm [I have contacted with Territory for the same but got no reply of email. Had talked with who ask me wait till end of this month. Today got to know they will not send Form1100 again through their website ]
As your GSM visa application was lodged before the changes made on 1 July 2010, you are able to seek nomination from a different state or territory government to the one you originally sought a nomination from at the time of lodging your visa application. If you can not obtain agreement from a state or territory government agency to nominate you, please contact the department to discuss any options available to you. [My occupation no longer in any SMP and talked with DIAC who ask to look for SS or any other VISA ]

In seeking a nomination from a state or territory government agency you should consider whether your nominated occupation is listed on the current SMP for your state or territory. SMPs commenced for all states and territories in late 2010 and early 2011, and specify which occupations state and territory governments can nominate applicants under. States and territories have a limited capacity to put forward nominations for occupations not listed on their Plan. These provisions allow states and territories further flexibility in providing nominations which may be valuable in meeting shortages in very specialised occupations. [Off list nomination is for onshore applicants mostly so I have rare/no chance]

It is important to note that it is entirely at the discretion of the state or territory government agencies to nominate applicants and to submit nominations of their choosing to the department. Once a nomination is received by the department, it will be considered and the nominating agency will be informed of the decision. [DIAC sounds like, passing ball to State/Territory and vice versa ]

If at the time your GSM visa application is assessed you do not have an approved nomination, your application may be decided based on the information before the case officer. Your visa application will not be successful if you do not have an approved nomination from a state or territory government agency. [ I guess I may suffer for the reason of DIAC and State's internal issues]

You may withdraw your application at any stage during processing if you no longer want to be considered for the grant of this visa. General Skilled Migration

I got the above mail from DIAC on 15-06-12 after almost 3 years waiting. Mail came from NoReply id, so no way mail them back. Have tried to sort this out with every possible way but no way in fact! Applied as PG-3 on Aug 09 but fall in lower priority on next month changes (23 Sep 09). After watching and waiting so long as PG-5, there was a light at the end of tunnel which about to END.

Any advise?
Any professional guideline

send them your copy of the state nomination and see what they say

I was attached this form with other documents on Dec 2009. Last monday i have forwarded that Territory mail with Form1100 again at [email protected]

If you want professional guidance, contact an agent - which might be a good idea in your position anyway :)

Not to me untill get the grant.

But in regards of Nomination/Form1100, have to check with DIAC.

Let me see what DIAC will say.

Talked with DIAC operator today who confirmed nomination(Form1100) issue has been sorted out on 28 June by approving Off-List Nomination.

File has been batched for CO and would expect to get assigned within 2/3 weeks.

Hope for the best.

hello Aituhin.

i think we are in the same dilemma. i am also a regional sponsored of RDANI and filed my 475 visa application last 29 june 2011. my concern right now is, i really don't have any idea if RDANI forwarded the form 1100 to DIAC. as i understand, i will received a cc when RDANI confirm my nomination to DIAC. but, until now, i haven't received any communication from them.. i did post lodgement inquiry to DIAC asking if they already receive the form 1100 from RDANI. i received the same message on your first paragraph from DIAC.
then, i keep on sending follow-up letter to RDANI, unfortunately no response from their end until now.
i am in a maze now. i keep on chasing and waiting for the bright light.
any feedback and advice guys. thanks

DIAC wants nomination again from the State as Off-list.

Keep contact with RDANI to get it again.

Got the Grant today!

Grant after 2 years 11 Months of Lodgement to DIAC.
Grant after 5 years 2 Months of Assessment.

congrats aituhin! your long waiting paid off!

may i ask some advice on what should i do to follow-up DIAC about the approval of my state nomination....received advised today from my state sponsor that my approved nomination was forwarded already to the department on 9/11/11. but, i still don't have CO allocation and my application states that on process....i did the post-lodgement inquiry to DIAC ask them if they have my form 1100, but they direct me to the regular site of state sponsorship....don't have any idea if they already have my form 1100...
your feedback will be a big help.
