Default Defacto visa for new partner?

Not sure this should be in the Barbie as it's a bore of a question.

However, here goes. I'm still technically married (haven't seen each other for 2+ years) but I have a boyfriend who as a South African struggles to get a visa for many places. Am I able to apply for a de facto partner visa for him? I'm a citizen. If so any idea of the expected time scale?

Meanwhile, hope everyone has a spanker of a new year's eve

Have you been "seeing" him or are you living together as man and wife for more than 12 months?

And unless you're divorced you're not technically married. You're married.

We have been living together on my yacht in Fiji for 12 months. Proving it would be possible but I guess it's unconventional.

Yeah, but I think you can still have a de facto with someone else even if you are still married.

Yes you can.

As long as you can prove that your new relationship iis your current one, and your old one is over - so living with the new partner, shared finances, all that stuff. Any proof that the old one is over (eg letters ending leases or closing acconts) could be handy, but you don't need a divorce or even a legal separation.

(info from the esteemed Mr Lombard a few years back but still current)

I have nothing useful to add (when do I ever?!?) but as Pollyana said, it's really good to see you and I'm glad to read that you're clearly happy and getting on with life!

The time scales are generally rather long and vary depending upon where applied from. Depending upon when you were hoping to enter Australia you might also look at the potential to apply onshore whereby your partner would obtain a bridging visa allowing them to remain in Australia until a decision has been made.

The partner visas application charges increased again on 1st Jan.
