good luck Trev. A crappy situation to be in, but I am sure you'll sort it somehow.

"time has gone on she is now 20 and not with her boyfriend and now wants to come with us".

Hi Lainey

Thanks again for sharing your story. I am so glad it has all come right for you all in the end.

The quote above is our big fear. She decides to stay here because of the BF and in a relatively short time they are no longer together and then it is too late for her to come out to us... unless she is lucky enough to get in on her own rights like your daughter.

We all have lots to discuss but her welfare is our main concern.

hello there might be a problem with your daughters age but you will have to check that there is some legislation that states if a couple of opersite sex have been together for over 12 months you can use a defacto or spouse visa but you do have to prove this with holiday documentation (so have they been on holiday together before) have they ever lived together, any kind of proof i know it will be hard to get proof but if there relationship was that serious then they would have done stuff together and you should be able to prove that. good luck

http://www.immi.gov.au/migrants/part...ty-sponsor.htm

Generally the sponsor must be 18....although the parent can act as sponsor.

However, the evidence they present should be of a relationship akin to marriage, joint financial arrangements etc. Ideally they would be living in their own place and not with parents which may not be something they are ready for. I guess if they could demonstrate the reasons this isn't a possibility then that may be acceptable (advice required on that one).

The most straightforward route would probably be for her to validate then return to the UK until she was 18. Then they could both return to Aus, he on a WHV...live together for a year and submit a spouse app. By that stage he may have even finished his studies??

There is a lot more to getting a de facto visa than just proving that the couple have been on holiday together. They would need proof of 12 months cohabitation just for starters.
