Default Couple of questions (139)

I'm hoping to apply under subclass 139 (skilled sponsored) and have a
few questions that I would appreciate some advice on.

Firstly, it states that an applicant must be under 45 at the time of
application. Now presumably this is the date at which the forms are
first submitted? The reason I question this is because I always had
the impression that you had to be under 45 on being granted your visa
and when I spoke to an agent at an immigration exhibition recently I
assumed this and he didn't correct me.

Secondly, it states that your sponsor must have been in the country
for 2 years. My sponsor has been in the country as a "temporary
permanent resident" for 18 months. Will I therefore need to wait 6
months before applying or could I send my application in early knowing
that by the time it gets processed the 2 years condition will have
been met? Also is there a specific definition of "in the county"? He
is not yet an Australian citizen but married an Australian in February
2003 and has been there ever since.

Also, if anyone else has applied under subclass 139 could they let me
know if its easier or quicker.
