Converting 176 to 175 ... Any issue?
 
Hi,

Is it possible to convert 176 into 175. I know 175 can be converted into 176.

I have 115 points at this moment. Expecting my SS approval soon and my plan is to apply for 176.

Meanwhile my wife's skill assessement is underway. The result is not expected before June. If she gets positive assessment then I can claim 5 points more (basic requirements fulfilled) and in that scenario I would attain 120 points. With 120 points I would be eligible for 175. Since I always prefer 175 over 176, would like to convert my 176 to 175. But is it allowed by DIAC?

Any advise would be highly appreciated.

Hi

Yes, it is possible to go both ways as the application you make can meet either 175 or 176 criteria. Let's say you lodge on 115 points without State Sponsorship, but nominate a SOL occupation for your spouse in the application but without skills assessment for her. Then the 1100 State sponsorship comes in and they assess you at 125 points for the 176 criteria and let's say they request medicals. You then provide yoru wife's skills assessment that exactly matches the occupation she nominated in your application. The 125 points cannot be increased to 130 as that is locked in. However, if you insisted, you can demand to be only considered for the 175 visa. DIAC may insist that you get the State to withdraw the State Sponsorship before processing it as a 175. When they now score for a 175 visa, you will get the extra 5 points and score the required 120, but your application may have lost a lot of processing priority and be put back in the queue.

Nice to hear that it is possible both ways :) but disappointed :( to know that converting 176 to 175 is not straight forward as i thought.

Well!! be in a queue is more important for me at this moment than overall processing time. I am going to USA for a year of deputation and would be ok if I get PR visa somewhere in May 2011. I wanted to be join queue as soon as possible as we never know when DIAC will changes the rules :)
