Default Combine two IETLS scores ?

Hi,

My friend was asked to do IELTS (for his Onshore student PR application),
but unfortunately, he has only 5 for listening (Overall 6).

However has 6.5 for listening in his previous attempt in IELTS-Academic
(which is more than two years old, and 5.5 for reading, 6 overall).

(He needs 20 points for English to meet 115).

Since DIMIA has set him a deadline which doesn't permit him
to take the IELTS again, I wonder whether he has any alernative ?

Yours comments are highly appreciated.

Thanks
Ranga

If your friend is still within the six month range of graduation of his degree, he may decide to withdarw his PR application and lodge a new one. It will be a waste of $1745 but will give him another opportunity for a fresh application and a new time frame He may retake the IELTS test again, or NAATI test if he is confident in his second language.

He cannot pick and choose which IELTS component is better from the two sittings.

In his situation, he won't get the 20 points, unfortunately.

If application is the onshore 880 visa, a better alternative to withdrawing is to let it be refused. Then an appeal can be lodged with the Migration Review Tribunal, further IELTS tests can be done and if successful, the review fee of $1400 aud is refunded.

Review can take some time, but that also gives the person more time to improve their english.

If it is for an onshore 880 visa application, will the applicant's bridging visa be renewed pending resolution of his/her appeal against the initial negative assessment?

Hi Peter

Yes, the bridging visa held will remain in effect until a 'final' decision is made on the application. Which if an appeal is lodged in the required period, will mean the appeal period at the MRT.

Hi Steven:
If it is a skilled Independent application (Category BN) lodged when the applicant in already in Australia on another substansive visa, and it is refused and the applicant goes to MRT, will she be permitted to remain in Autsralia while waiting for a decision? Will she be issued a bridging visa or any other visa to cover the period?

HI

If the application is a 136-BN then no bridging visa is issued as part of that application. Also it is not a reviewable visa class so no review at the MRT can be lodged against that class (review can be lodged however against 880s, 138, 139s etc).

Hi All,

Thank you very much for all the information you have given.
That really showed us the way !

My friend is going to meet a migration agent and work
on a solution.

Again, thanks a lot.

Ranga
