Buddy - you already heard the "factual information" that you are looking for from DIAC - which is that your spouse isn't eligible until whenever she is as per the department.

If you want to go ahead and apply by all means do so, nobody is tying your hands here.

Your application will be refused first, then you will need to fight it out in court. By the time you get to that point it is most likely that your spouse will be eligible anyways... if you want to spend your time & money in going through the process, please... your are most welcome to do so.
