Where a child from a previous marriage is not migrating and lives with the other parent/stepfather, I am aware that a medical still needs to be done.
However, in the application form it asks to provide evidence of access and custody arrangements. Does this only apply to those children who are migrating (ie included in the application)??
What if there is no court orders or documentation? My daughter lives with her mum and stepdad and when we divorced, the arrangements were, and still are verbal as things are fairly amicable.
OP

The spouse visa is quite specific about the evidence required IF the child is migrating with you. However, nothing more than the medical is mentioned otherwise.

Hi there,
My hubby has been granted a spouse visa recently and he has a child from his previous marriage. He was not asked to provide any details regarding access/custody at all or his daughter, but they did insist on the medical being done, which we had major problems to start with coz the ex refused to arrange it.
So as long as you can get the medical done yourselves, or the ex agrees to do it, you will be fine.
The custody/access part is only really for children who are emigrating.
Good luck!!

Have you tried reading up on it in the booklet which goes with your visa application?
