Default Brazilian Partner Migration

Hi, I'm a (British) Australian Permanent Resident currently in Brazil looking for information on Partner Migration for my fiance who is Brazilian. We want to travel to Australia in the next few months (him as a visitor) and I was hoping to apply for a Prospective Marriage or Partner (spouse) visa while there and I am supporting him but I believe you must be outside of the country to apply for these visas. Does anyone have any insight on this, whether its possible to apply in Australia whilst he is on a visitor visa? Also has anyone here successfully migrated a Brazilian spouse to Australia?

Do you mean you want to move to Australia in a few months, but have not done anything about the visa yet? If so why not make this easy for yourselves and apply for and get the visa *before* you go?

To your question, PMV is an offshore visa, partner visa is either on or offshore. But that does not mean it is a good idea to travel to the country on a tourist visa if the intent is not tourism, especially if Brazil is deemed a high risk country I would not take the chance.

Thanks for the reply Bermudashorts. Initially the intention is to travel to Australia as soon as possible, a tourist visa being the quickest way for my partner. I want him to at least visit the country before we start the Partner Migration process. He will have a return flight booked and we are willing to return to Brazil to apply for the Partner Migration visa but I am wondering if it is possible for us to apply for the visa in Australia if we decide to extend our stay and do it this way. Please note, he will not be working during this time, I will be supporting him so he will not be doing anything illegal.

What are your thoughts...

Yes he can apply onshire for a Spouse Visa, just be aware that he should not INTEND to do tht - he should only travel here with the intention of being a tourist.

Partner visa (subclasses 820 and 801)
