804 desperate for clarification

Default 804 desperate for clarification

Hi Everyone We applied for 804 onshore and it was acknowledged within 4 days together with a Bridging Visa "A" this BVA did not come into use as we were on a E Visa (651) so BVA cannot come into force until this expired

We returned to the UK and had problems with a sick relative so did not return quickly The E Visa expired and we were still in the uk a couple of months passed and so we applied for a new E Visa (651) which was granted with no conditions. that expires in April 2019 and we intend to hopefully renew it again and travel sometime this year

What I wanted to ask would the BVA start at the end of this E Visa 651 on the expiry date......... or have we lost our right to the BVA therefore our application for the 804



We could not apply for a BV "B" as the original VV E Visa was still running

804 acknowledgement May 2017 BVA May 2017 bu not valid while E Visa running had 2 E Visa's since no restrictions on both expires April 2019 will need another E Visa What will our position be re our 804 Still current or not ?????

I think you need to consult with a registered agent.
The idea of the BVA is that it enables you to stay onshore between the expiry of one visa, and the decision on a second one. I suspect (though am more than happy tobe proved wrong) that yur BVA no longer exists, owing to the fact you left the country.
The 804 application should still be current, its only the BVA - and your right to stay onshore until grant - which would have ceased to exist.

Generally speaking, it is correct that the BVA ceased when you left the country, but the application did not. If you can get onshore with an eVisitor, you can apply for another BVA.

You could have applied for the BVB, whilst on the visitor visa and before the BVA came into effect.

As suggested, some professional advice with all the facts known would allow you to plan ahead to get this sorted out.

Interesting, I did think they might have been able to get the BVB even if the A wasn't in effect, but I didn't now that they could actually apply for a new BVA once back onshore. Thanks!
