Default 309 visa - how difficult is it?

Hi all,

Some advice on the following would be greatly appreciated please!

My wife and I are looking to permanently relocate to Australia. I am British and have always resided in the UK. My wife was born in Australia but moved to the UK about 10 years ago. We have been married for 8 years and my wife was granted British citizenship about 3 years ago meaning that she's now a dual British/Australian citizen.

Am I right in thinking that the 309 form is the one I need to apply for? If so, is it easy enough to complete yourself or would you recommend using a specialist agent assist?

Also, is it absolutely necessary to complete form 80? I've been told by some agents that it's not necessary.

Many thanks!

If you’be been married for eight years then there would be little advantage in using an agent. And no, Form 80 is not necessary for British citizens, unless you’ve been spending time in ‘interesting’ countries. Even then you should only provide it if your case officer requests it.

Many thanks for taking the time to reply - it's greatly appreciated and very reassuring!

Given that the visa itself is naturally quite expensive, it would be nice to save money on the agent's fee which appears to be about £1,300.

Thanks again!

To obtain a considered professional opinion from a registered migration agent should cost you less than 10% of that amount.

Less than $130? Unless you're talking about a free initial consult that's nonsense.

OP given your situation, the application is very straightforward and it's highly unlikely you'll need professional advice.

And just to add that with 8 years of marriage you should be granted the 100 and get PR straightaway. The application is the same as for the 309.

Mr Dutton said it was costing the Australian taxpayer “tens of millions of dollars a year” to take on the AAT and that too many lawyers were willing to give free legal advice to refugees who want to appeal against deportation and other orders.

Here is an extract from an email from a solicitor who thought I had not charged him enough:

************************************************** *********************************************
*Can't find the PayPal thing on your website but would like to contribute $360 Australian to the Australian National Treat Westly's Great Grand Kids as a Token of Deep Appreciation Fund (NSW Division).

************************************************** ************************************************** ***

and from another client I undercharged:

************************************************** **************************************************

Looks like everything matches up correctly.

We are still buzzing .

I would be grateful if you could kindly confirm if you are able to recieve a gift payment into your usual account from our family to thank you for your efforts and patience and most of all the long awaited visas. I would very much like to send you a little something so that you may treat yourself to a bottle of something fizzy or possibly to help purchase a T-Rex alarm for your grandchildren....you may then get some sleep....

Much gratitude Westly....thank you so very much xx

************************************************** ********************************
Dear xxx Thank you for your kind offer, but if you plan to live in Sydney you will need every cent you can rake up. Of those grandchildren who live with me, the eldest starts high school (year 7) this year.

************************************************** *******************************

I have many emails from clients who have told me that I do not (did not) charge enough. I shall not burden you with all of them.
