309 visa - how difficult is it?
Hi all,
Some advice on the following would be greatly appreciated please!
My wife and I are looking to permanently relocate to Australia. I am British and have always resided in the UK. My wife was born in Australia but moved to the UK about 10 years ago. We have been married for 8 years and my wife was granted British citizenship about 3 years ago meaning that she's now a dual British/Australian citizen.
Am I right in thinking that the 309 form is the one I need to apply for? If so, is it easy enough to complete yourself or would you recommend using a specialist agent assist?
Also, is it absolutely necessary to complete form 80? I've been told by some agents that it's not necessary.

If you’be been married for eight years then there would be little advantage in using an agent. And no, Form 80 is not necessary for British citizens, unless you’ve been spending time in ‘interesting’ countries. Even then you should only provide it if your case officer requests it.

Many thanks for taking the time to reply - it's greatly appreciated and very reassuring!
Given that the visa itself is naturally quite expensive, it would be nice to save money on the agent's fee which appears to be about £1,300.

To obtain a considered professional opinion from a registered migration agent should cost you less than 10% of that amount.

Here is an extract from an email from a solicitor who thought I had not charged him enough:

Looks like everything matches up correctly.
We are still buzzing .
I would be grateful if you could kindly confirm if you are able to recieve a gift payment into your usual account from our family to thank you for your efforts and patience and most of all the long awaited visas. I would very much like to send you a little something so that you may treat yourself to a bottle of something fizzy or possibly to help purchase a T-Rex alarm for your grandchildren....you may then get some sleep....

Mr Dutton said it was costing the Australian taxpayer “tens of millions of dollars a year” to take on the AAT and that too many lawyers were willing to give free legal advice to refugees who want to appeal against deportation and other orders.
