175 (offshore) Advice needed.
 

Hi all,

Firstly please allow me to describe my situation.

I'm 28 years old now (birthday is June, 6 1982) and i do have intentions to apply for 175 visa (skilled independent). I also will pass IELTS on August 21th. I live in Russian Federation (Rostov-on-Don city). I have an engineer qualification (diploma from my university; 5,5 years of learning; saying that i am the specialist — "Mechanical Engineer Technologist"), but actually i am an IT-guy (self-employed).

I see two different ways to immigrate to Australia. First of all i need to get assessment. I can apply to ACS via RPL (6 years of stage because i have non-IT diploma) and can show all my projects which have been released since 2002-2003 till nowadays. In this case i can take the references from my customers as i am self-employed. All my customers can approve that these projects are not fake and i've been working as a developer on them.

According to the SOL (Schedule 3) i need to apply for ICT Business Analyst. Key responsibilities of my occupation are really almost the same as the nominated occupation, they can be easily checked via the references. But i don't have any additional evidence of the work been done, e.g. payslips and so on. The one and only evidence i can provide are references from my customers.

I've been payed by cash (black cash) so i have no chance to approve it. Another way is to pass the assesment via the IEA (i can also easily write the CDR (3 career episodes) based on my engineer experience during the study in university (let's say it will be term works, practice and diploma work)). But as far as i know, DIAC will require at least one or two years of the work highly relevant to the nominated job.

And in case of variant "A" (ACS assessment) i can show such experience, but in the case of variant "B" i can't because i haven't been working as an engineer. Now i would like to start the immigration process but don't know what exactly to do, understanding that i have only one attempt and any mistake can result in epic fail.

I think thats not right....

There are two experiences used for PR... one is required for eligibility and one is optional used to claim points... Required = Recent work experience experience, optional = specific work experience.....

On the eligbility requirement of 175 visa, for recent work exepericent which is manditory, it is written...

" To meet the recent work experience requirement, you must demonstrate that you have been employed: in an occupation listed on the Skilled Occupation List (SOL) See here

So, as per my understanding this can be any occupation......

Secondly, if you want to claim 10 or 5 points for specific work experience, then you have the following clause....

you have been employed in your nominated occupation, or a closely related occupation listed on the SOL, for at least three (3) of the four (4) years before the day of your application. See here

So I would say you to rethink your options with this information......

I didn't really understand what you were saying about the occupation so not going to attempt to comment on that. But I think being paid in cash and not being able to prove you were in paid employment could be a big problem.

I can prove my employment via references taken from my customers. All of them (approx ~50 customers (big projects)) can't lie at one moment, right? Or DIAC will only trust to payslips???

DIAC ask for references as well as evidence of salary (or in your case payment). Maybe they will make an exception for you, I am just not sure why they would do that.

Hi members

I have a positive assessment result in July, 10 from Engineers Australia applied as an Electronic Engineer being assessed in ANZSCO for the new SOL list as an offshore applicant. I have a 3 year relevant experience in my occupation outside Australia, IELTS band is 6.5 and age is 27.

Soon I will be going to apply to DIAC online. I am thinking to apply in independent subclass 175 rather regional sponsored because I don't have any relative in Australia or any State/Territory sponsorship is that suitable option to me according to my above mentioned occupation with other factors?

Secondly when will DIAC require its processing fees of 2500 Aus$? I have to pay at the time of applying and submitting application or will require on installment basis in split time period?

I think that all the new applications after July 01, 2010 have to have an IELTS score of 7 in each area and you seem to have 6.5...

Thats not true at all.... total rumor... only possibility that is closest to what you are suggesting is is that Accountants need 7 band for skills assessment... that too I am not 100% sure....

but what I am 100% sure is that all applicants does not need to have 7 for eligibility.... minimum 6 is required if you can meet 120 points for 175 or 100 points for 176 visa....

Yes thats correct the minimum requirement for IELTS is still 6.0..

Are you sure you have 120 points for 175? If so 175 is the wisest option since you meet all the requirement for 120 points i guess, so go ahead and lodge your application.... the more you wait, the father you will go in the queue....

and if in future, electronics engineering comes to SMP, you can always apply for that SMP for faster processing... I am not sure though if your application will be converted automatically without re-lodging application..

not 100% sure about second question.... but I think there is no installment option... you have to pay upfront all fee at the time of application..

Thanks for your reply. If I do not meet the 175 criteria of 120points then which will be the appropriate option for me?
I have also heard that there is a need of 100points for 175 is that true?

No thats not true...

For 175 (skilled independent visa), you need 120 points
for 176 (sponsered visa... family or state), you need 100 points...

You can either go for 176 or go for higher band in IELTS... I think that will make your points to 120..

I have calculated my points it is a total of 115. Now what you suggest either 175 or 176. But for 176 I must meet the sponsorship requirement that I dont possess. If you suggest 176 then is there any option available for getting state/territory sponsorship.

What is the difference between 175 and 475. Can I also apply in 475 if 175/176 not applicable?
