Hi

I wish to apply for a 138 visa to Australia and have been doing a lot
of research, on this site and the internet in general, but now I have
come to a bit of a tricky situation and I was wondering if anyone could
offer me advice.

I'm an office manager at a financial institution in London and I'll be
applying for a 138 visa. My brother, who lives in Sydney, will be
sponsoring me. The only problem is that my occupation is not listed on
the Sydney and Selected Aread Skilled Shortage List (SSASSL), which
means that whilst my brother is living in Sydney, he can't sponsor me.
However, he will be moving to Perth in 6 months. Now my question is as
follows: How long does he need to live in Perth before he can be
eligible to sponsor me? (He has been living in Sydney for 15 months)
Or am I lucky enough that the period he lived in Sydney will count?

I think he just needs to be living in Perth.

There isn't a question on the form which asks how long hes been at his address - just how long hes been in Australia (which I think needs to be 2 years?).

Hi Joanne,

He needs to be "resident" in Perth, not just visiting. How long you need to be physically present (if at all) before you're resident in a particular place is a bit uncertain - would depend on his circumstances - but once he's resident somewhere else, the period he spent in Sydney is irrelevant.

For the 138 visa, there isn't a 2-year period of residence per se. This is more applicable to the now-retired 139 visa and its successor.
