Can anyone clarify a point for me please.
If you are say 44 yrs old when you get placed on this database what happens when you turn 45yrs? Are you removed as your age at point of sponsorship would be over 45 or is it the age you register on the database that is relevant?
Anyone any experience of getting a PR this way? State or employer?
Ta - looking for a PR route still

can't see there's anything to lose by applying in that case ..... can always remove name from list if we get PR some other way in the meantime but age is a big worry and if it buys another couple of years that's great
- I believe it only costs money when you get a sponsor - already had skills assessed (i presume this will need renewing if sponsor shows up after it's expired though)

You can only apply for 134 visa before 01 September 2007 - it does not exist anymore.
So the only way to preserve your age at 44 would be to apply for the Skilled Migrant visa (subclass 175/176), costs A$2,060. The pool marks for 175 and 176 are 100 and 80 respectively but if you are applying without an STNI sponsorship, or family sponsorship in place, you would need to score a minimum of 100 to ensure you enter the pool. You are then kept in the pool for 2 years - unless one of the following happens within 2 years of entering the pool, your application is eventually refused:
1 you get an RSMS or ENS
2 you get an STNI sponsorship
3 you get a family sponsorship
4 the pass-mark is reduced and your total equals or exceeds the new pass-mark
Further comments on the above four ways out of the pool:
1 An age waiver is possible eventhough you may have turned 45 but having to prove "exceptional circumstances" are avoided if you apply for 175/176 before turning 45. You must get nominated by the employer AND lodge the Form 47ES during the processing of the 175/176 application OR within 2 years of being placed in the pool.
2 STNI sponsorship can come in any time during the processing of the 175/176 visa OR within 2 years of being placed in the pool - so a good way to extend your time if you are turning 45 soon and only have time to sort the skills assessment but do not have the time to get the STNI processed.
3 Again, although the pool mark is 80, you will need to score 100 to get pooled if there is no family sponsorship when they assess your application. Family sponsorship can come in any time during 175/176 application OR within 2 years of being placed in the pool. So for those turning 45, and are sure a relative will be migrating in the next 2 years or so, this is a great way to effectively remain under 45 for 2 to 3 years.
4 Dream on
If you think you could take anvantage of any of the above, make sure you run all your circumstances past a registered migration agent who is familiar with these technicalities.

2. again does this mean that the age req for a STNI is waived if a 175 (pooled) has already been lodged before turning 45yrs? Even though they are different visas? At the mo we aren't on any STNI lists
3. No family in oz
4. I can dream!!! If you find a way of having more points whilst pooled can these be added to your score or is it fixed at time of application?

1. Sorry to be dim but does this mean that the age waiver is not need for a 121 or 119 if a pooled 175 has already been lodged before turning 45yrs? Even though they are different visas?

2 - no waiver - when you apply for the skilled migrant visa, you apply for the subclasses 175 and 176 - so you get pooled under the 175 for scoring 100 points but less than 120 - the 176 (STNI) is still undecided because of the pooling of the 175 so when an STNI nomination is submitted to DIAC, they resume processing of a 176 application which you applied for before turning 45.
3 - family can move there during your pool stage and sponsor you imemdiately they arrive as permanent residents
4 - actual score is never re-assessed after you enter the pool, your score total can only be compared with any new (reduced) passmarks.

1 - correct as long as you have been nominated and lodge the form 47ES (no fee required) within 2 years of being pooled

Basically it seems we need to lodge a 175/176 application (didn't realise it was one joint app for both visas)
then if we find
(a) an employer willing to sponsor and submit 47ES within the pool 2 yrs OR
(b) we appear on a stni list and gain state sponsorship within the 2yrs
then the fact that by then 45th birthday has been passed won't matter - it'll be like it never happened and we're still 44yrs!
(I wish I could freeze all my birthdays like that!)
Like you said better get an agent if we go that route - wouldn't want to lose last chance by getting it wrong!

that's great thanks. That buys 2 more years for $2000 - bargain

When the winds of changes shift
May your heart always be joyful
And may your song always be sung
May you stay forever young
Forever young, forever young
May you stay forever young.
