Skilled Migrant created job-asking for trouble?
 

I have 125 points with no job offer. I have a contact in New Zealand who could potentially help me out by 'creating a job' that satisfies the skilled job offer criteria. Now, if I get offered a PR is there a period where they will check up on this job - I read 3 months somewhere. Or, can I not take up 'the created job when I get to NZ, as I have intentions to run my own business that I have already identified.

I know this is not by the book, but I'm supporting myself, not asking for any handouts and just want the quickest way to get to NZ. I've heard the LTBV is a nightmare. Is my plan a possible option or askign for trouble?

Any thoughts appreciated.

Your contact cannot just create a job. It doesn't work like that.

Any NZ employer wanting to employ someone from overseas would need to be able to prove to NZIS and the Dept of Labourt that there is no NZ citizen or resident that could fill the vacancy. They would have to show adverts placed over a period of time, and provide information about training programmes. Also, the NZ Dept of Employment would employ a labour market test against the proposed vacancy . This means they would look at the job offered and then look at those NZ residents and citizens looking for work to see whether or not someone already here could fill that vacancy. It is a standard procedure and per policy .

I think that if your contact thinks they can do this then they perhaps don't understand the process as BEVS has outlined. Falling foul of NZIS would have repercussions for both of you.

Assume you don't qualify for a working holiday visa or any other legitimate form of visa?

Oh, is the "internet business franchise with no fixed assets" the "proper" business you are considering or the spoof???
