Keep going You've come so far already and this is the last hurdle.
Have a word with your CO and see what she says first.

I know it's hard but try and stay positive. It must feel like they're giving with one hand but taking away with another

Good luck and take care!

It sounds like they are really giving you a hard time of it ! Keep on hanging in there, otherwise I'm sure you would regret it.

Can anyone tell me about "Medical Waiver"??
I'm a bit shocked at the attitude of the MA. Why wasn't the report from the specialist considered full enough?

What the MA is looking for is how much you could cost NZ int he future and if the condition could worsen for any reason.

Below is a quote from NZIS operations manual re. health criteria. It may help you or your consultant form an appropriate report and response for the NZIS MA which the MA will be satisfied with.

A4.10 Acceptable standard of health (applicants for residence)

1. Applicants for residence visas and permits must have an acceptable standard of health unless they have been granted a medical waiver. An application for residence must be declined if any person included in that application is assessed as not having an acceptable standard of health and a medical waiver is not granted (see A4.60).
2. Applicants for residence are considered to have an acceptable standard of health if they are:
1. unlikely to be a danger to public health; and
2. unlikely to impose significant costs or demands on New Zealand's health services or special education services; and
3. (unless the applicant is sponsored for residence by a person who holds refugee status in New Zealand) able to undertake the work on the basis of which they are applying for a visa or permit, or which is a requirement for the issue or grant of the visa or permit.

3. The conditions listed in Appendix 10 are considered to impose significant costs and/or demands on New Zealand's health and/or special education services. Where a visa or immigration officer is satisfied (as a result of advice from an Immigration New Zealand medical assessor) that an applicant has one of the listed conditions, that applicant will be assessed as not having an acceptable standard of health.
4. If a visa or immigration officer is not initially satisfied that an applicant for residence has an acceptable standard of health, they must refer the matter for assessment to an Immigration New Zealand medical assessor (or the Ministry of Education as appropriate).

A4.10.1 Assessment of whether an applicant for residence is unlikely to impose significant costs on New Zealand's health services

1. The requirement that an applicant for residence must be unlikely to impose significant costs on New Zealand's health services is not met if, in the opinion of an Immigration New Zealand medical assessor, there is a relatively high probability that the applicant's medical condition or group of conditions will require health services costing in excess of $25,000.

Note: Assessment will be in terms of current costs with no inflation adjustment.
2. In the case of acute medical conditions, the medical assessor will provide an opinion on whether there is a relatively high probability that the condition or group of conditions will require health services costing in excess of NZ$25,000 within a period of four years from the date the assessment against health requirements policy is made.
3. In the case of chronic recurring medical conditions, the medical assessor will provide an opinion on whether, over the predicted course of the condition or group of conditions, there is a relatively high probability that the condition or group of conditions will require health services costing in excess of NZ$25,000.

Hey!
All I had was two kidneys on the right n one of them was "dead" so I had it removed... It's not a condition as I am very healthy n all is functionning well! Blood test to proove this!
The MA initially requested a report on my current state, treatment n prognosis to included future medical/surgical needs!
The report I provided from my specialist clearly answered his request. The MA is not happy as it was answered in one sentence but since there's nothing to say I don't see why my specialist should go on n on about it...
The CO said to me last night that her n colleagues never came accross such a case n that she doesn't know what to do really!!! She agreed that to her eyes my specialist report clearly answered the questions! She said she would speak to her team supervisor/manager today n see what can be done.
She also said that she is VERY satisifed with all the rest... Meaning the minute it's signed off I could be on my way...

I've not slept for 2days now... Specialist is a surgeon n has been in theatre since... I broke into tears on the phone with his PA this morning... She promised to get back this afternoon... Am a mess!

On a positive note, my CO is very nice n seems to care!

I am hoping your CO speaks to someone higher up ASAP and gets this sorted. I suspect the MA is just covering his back-in that it sounds like an unusual case [to me though!I can't speak for the human side of things]
Can the medical report be referred to someone else as you mentioned earlier?

Though it is good in that once this is done, you'll be on your way
I don't even know what to say to make you feel better and I don't suppose the words exist. Just hoping I see a big "I'll be on that plane on the .....insert date..." post very soon. Thinking of you.

I can not believe I forgot to update you guys...

Yesterday (Monday) my specialist finally emailed my CO (copied me in) with a "well written" report (!!!) which says the same with more word & sentences...

Within 5 minutes, I emailed her to check it was ok to which she replied straight away...

She confirmed that she has re-referred my medicals & we should hear back within a week (urgent referral)...

I truly hope that THIS IS the LAST hurdle...

Will keep you guys posted... Fingers crossed!

CLEARLY NO!

I thought I'd let Tuesday go away as everyone needs an extra day to recover from Bank Holidays... (?!?)

Called my CO on Wed, left a voicemail... No callback!

Called this morning - voicemail...
Called again - she answered!! Only to be told she has not heard back from the MA yet... Well in my books it's been 8 working days so nearly two weeks... CO told it'd take one week!!! She said she'll speak to her manager for him/her to give the MA a kick up the bum... But I wonder what would have happened if I hadn't called???

I have been VERY understanding, calm & proactive so far... However I feel SO frustrated...
