NZ Citizen, Partner and Child Help!
 
Hi,

i've been in touch with a few of the gov departs via e-mail but cant seem to get a straight answer.

I am a NZ citizen, by decent, i have live with my partner for 5 years and we now have a 7 week old baby.

We had planned on being in NZ in november, my partner had a 2 Year Working Holiday Visa approved but we only found out she was 6 months pregnant 2 weeks before we were due to fly! We sold up everthing and are now living with my parents, I also have a £6,000 camper sat on a friends driveway in Auckland!

So we still really want to go, but dont know if we can anymore?

As a NZ Citizen do i have to apply for Residence?

I had heard the costs of this were quite high?

Can i sponsor my partner and child as i have never lived in NZ?


Any help would be much appreciated!

Hi,
As an NZ Citizen you have the right to come and go as you please into or out of NZ assuming you have an up to date passport.
The certificate you received when you claimed NZ Citizenship by descent is required to apply for an NZ passport, so no you don't need to apply for Residency.

Yes you can sponsor or more to the point support your partner and child in their Residency applications under the Family Stream, however I'm of the opinion you must already be living in the country for that to happen ?

I do have a NZ passport, i'm just unsure now how to go about things, some people had told me i might need to live in NZ for 2 years before they can join me?

Are you planning on staying in NZ longterm? The options for your partner are residency or a temporary partnership visa.

I can see no requirement for you to be living in NZ for her and your child to apply for residency on the back of partnership.

There is a temporary based partnership option if you're only planning to be in NZ for 1-2 years.
You will need a NZ passport

Planning long tern, so go on temporary partnership then apply for residency when there?

If you're planning on staying long term then residency is the way to go first. No point paying for a temp visa and then having to pay for residency later on.
It's just an extra cost unless you're certain that you'll not be staying more than 2 years.

You will need to prove history of your relationship. You can pass on your NZ citizenship to your child only if you have lived in NZ for 5yrs I think.

my word is not gospel just stuff I hve discovered when I've researched for my family.

In fact, a New Zealand citizen by descent has to apply for a grant of NZ citizenship in order to be able to pass on citizenship to non-NZ born children. The residence requirement is 5 years in NZ if aged 16 or over, no residence requirement (other than settlement) if under 16.

The application has to be made to the Citizenship Office. Most eligible NZ citizens by descent never apply, and only find out later on that they should have done so.
