Moving back to NZ with UK born child
 
Hi there, my wife and I lived in NZ for 10 years.

Moved there in 1999, came back to the UK in 2009, temporarily due to family illness, we stayed longer than we wanted but are now in the position to return permanently.

We both have IRRV's and had started the application off for citizenship (hard as we were always travelling and need to stay in NZ long enough to qualify), but never completed this due to time frames and urgency to return to the UK.

We know we can return without issue (will be working for the Govt. and can get help in that area), but whilst we were back we had a son.

He is now 1, and about to apply for his UK passport, just wondering what difficulties if any we will have in taking him back to NZ?

I guess he wont get an IRRV, but what visa will he have, or does he require any?

I cannot imagine they will allow us back in but not our son??

Any advice would be great, I have emailed a contact within internal affairs, but expect it will take them a week or so to respond, and may just pass me to immigration anyway. :confused:

No such thing as IRRV by descent, your son needs an immigrant visa and you'll have to sponsor for that. http://www.immigration.govt.nz

You don't tell us when you got permanent residence, but if it was before the rules changed in 2005, they were quite flexible on time outside NZ as long as you were "ordinarily resident".

Probably too late for that now, although when you get back to NZ you should check if your application has been formally refused or if it's still open.

If it has been refused, you'll have to reapply - and that means starting from scratch on the new 5 year residence requirement.

Thanks for your response, the original visa's for us both were granted in 2002.
I had a new UK passport in 2007 - Had the IRRV put in my new UK passport then.

I spoke to the NZ immigration before we left and said we would be gone a year or two to support family, the answer was "your visa is indefinite and will be renewed on return to NZ" - has there been a rule change since I left in 2009?

My wife has to renew her UK passport in the next month and then send on to NZ house for the visa update, I guess if there has been a change we will find out then!

No rule change. But once again the fact you have IRRV does not automatically give your son one. He needs to be sponsored for permanent residence.

You could have applied for New Zealand citizenship anytime from 2005, it seems, up to the point at which you left.
