essential skills work visa HELP!
 

hello everyone! very nice to be speaking to you all! ok, so here is the issue.... my husband has been offered a job in auckland. we have to go on a temp work visa and his employer has to provide evidence of her trying to find a suitable kiwi to do the job which she has tried to do with WINZ and seek. my question to you all is, has anyone gone through this and come out the other side? once my husband has another year work experience we can lodge for residence. just wanted to hear from brits that have gone through a similar process. also, looking to buy around remuera, my parents live in tauranga so any where south of remuera thats not mega expensive and has good schools really would be good. thank you so very much for taking the time to read this. lots of love x

Just to clarify is your husband applying for an essential skills visa or a temp work visa?

We've just been through getting an essential skills visa so the process is still very clear in my mind :-)

hello there! thanks for your reply. we are applying for a temp work visa under the essential skills category. did your husbands employer have to prove they couldnt find a kiwi to employ? or did he has skills on the shortage list? have you left the uk yet? congratulations on your visas, that must feel amazing!

OK I understand now.

My husband got an essential skills visa, his job is on the skills shortage list.

The company did have to provide proof that they couldn't find someone in NZ. However they have a lot of expats working for the company so it's a process they are quite familiar with. We didn't have much to do with that side of things.

Im still in the UK with the kids, but my husband has already started work. He's loving Auckland. We leave on the 9th of Sept to join him.

oh wow what fantastic news, i feel really happy for you and only hope i can feel happy for myself in the near future. my mum and dad and brothers live in tauranga and have for nearly 9 years now, my husbands family have all unfortunately passed now so it just me him and the 3 kids. 27-30 hour flight with 3 kids, am i mad?! where about in aucks are you guys going to be living? are you buying? really nice to actually speak to other people in the same situation as me! thanks so much!

Well. This is positive news really isn't it. I remember that not too long ago you writing that you had tried everything to gain a job offer and coming up with a big fat zero. So, I am very pleased to read that your perseverance has paid off.

I am assuming this is under the occupation Landscape Gardener which is seen as a skilled occupation, so could lead to NZ residency once you have the points.

Yes. People have been given job offers where the NZ employer has needed to prove no NZ resident or citizen could take up that job & come out the other side of that. It is not 100% certain of course. It all depends on the quality of the job offer and what the employer can produce by way of evidence.

The employer needs to show their vacancy adverts as you know. Also training records . NZIS itself will use the NZ Dept of Labour to apply a labour test using the local WINZ offices to see who could /could not take up that work.

So. :fingerscrossed: for you. If the employer is looking for a skilled level for this occupation ( even better if it is supervisory perhaps) and is paying a good 'going rate'. Has all evidence to show they have been unsuccessfully advertising for some fair old time , then this could be a good shot.

Is this a large employer? Could they go for accreditation if NZIS become pernickity?

how lovely of you to remember me! yes it has been a really hard slog but fingers crossed it pays off. we went for residence a few weeks ago but unfortunately becuase my husband could only prove 2 of the 3 years of accounts with HMRC we were going to be declined. my immigration officer helped us and spoke to the residence case officer and we managed to withdraw the application to save our selves being declined. so its been a bit of a rocky road and im hoping this will be the end of it as we have spent a large amount of our savings on this now. the lady offering the job, owns a large garden store in remuera , its a big franchise in nz i believe. im sure she could go for accreditation as she really does need workers and there seems to be none in aucks that fit what she wants. do you know she would go about getting this? perhaps i should suggest this to her if this fails. people on this site are so nice and friendly, its a pleasure to speak to u, thank u!

they have to apply annually or they lose their status but if they don't need any more employees then they won't have to apply again

Congratulations on your husband's job offer...

I was offered a job in May 2014 and we had to apply through the Essential Skills for a Temporary 36 months visa. My new employer paid a specialist and we started the process on the 26th June 2014 when I signed my new contract. I submitted our forms to London on the 15th August 2014 with a form from my employer stating they had looked in NZ for staff, this included evidence from recruitment agencies and a detailed record of all NZ potential staff interviewed and why they did not match the job role.

We received our Temp Visa's in 4 working days!!!!! on the 20th August 2014 we had our passports in our hand....

I was expecting it to take 25 days so was really surprised but delighted :thumbsup:

im terribly sorry for my late reply, i didnt receive an email to say you had responded! can i please ask what it is you do for a living? my husband is a landscape gardener. we have put in our papers and my husbands (hopefully) new boss has genuinly tried to recruit others and has a letter from WINZ stating this but has been unable to. i dont think she has lots of evidence like your boss did though, hmmmmmm, this makes me worry! we put in our papers on tuesday, so im hoping we may hear very soon, but im pretty sure they will need to do a labour market test :( im over the moon for you, you must be so happy. i bet theres no feeling like it, when do u move over? are u taking all ur belongings? im praying it comes good for us too, its been a long 10 years!

hi desperateBrit - my partner and I are taking pretty much everything! (except the kitchen sink).

We are taking our bed, mattrass, sofas, rugs, coffee table etc etc - the only things we arent taking are things that we will need right away and cant wait for shipping to arrive like iron, kettle, pillows etc

So will have to figure out where to buy stuff from when we get there! We are working on principal that cheaper to ship than buy again and our stuff is still in good condition.

I wouldn't bother with the beds or mattresses as you will need them when you arrive. they are different sizes as well over here so to get sheets and covers that fit properly you have to order from good old Marks n Spencers

We leave 7th December! My job is in Wellington! I finish work 10 weeks today - doesn't seem real! Had awesome deal on flights!

I hadn't heard about the bed sheets / beds being different sizes! I will shove some more sheets in the container now!

From the forum I think I have same worries as everyone else. Will keep fingers and toes crossed! When do you leave uk desperatebrit???
