Comparable Market Important Question

Background ---
Points - 145
No Job offer
Degree - Bachelor and Master Comp Sc.
Profession - ICT (under shortage list)
work EX - mid 2005 to mid 2007 - Company A (location INDIA)
work EX - mid 2007 to mid 2008 - same Company A (location US)
Experience letter says it all together from 2005 to 2008
company A is - multinational - headquatered in the US with operations everywhere since many many years.
EOI done - ITA done - Interview done(last thursday)

Issue ----
NOW it Seems like CO was looking from us a US visa from 2005 to 2008, thinking that the exp will be 3 years in the US location all together (since the letter also comes from new jersey, USA) and points awarding for that.
yesterday we emailed her saying that 2005 to 2007 experience was in INDIA (non-comparable market).
and 2007 to 2008 exp was in the US (comparable market)

Questions ----
is that a problem?
can she deny, WTR or PR ?
can she recalculate points?
Isn't it so that since the company is HQ in new jersey, the experience counts as a total?
Also in the EOI guide another clause is that if your exp is in skills shortage then comparable or non-comparable market should not matter!!

Please help !!

Well it only is if your case officer says it is, better wait until they give a view on it making a difference before you panic...
