Applying for PR but been living apart due to work
 
Hi! I'm new to his forum, thankful I found this and hope somebody here could help me in my queries. I'm currently in CHC on an essentials skills work visa for more than a year now and just recently I submitted my EOI and get selected last Feb. 4, still waiting to be successful to be invited to apply, fingers crossed! I included my wife and my 1 year old child in my application as partner and dependent. Sorry for the long intro.

Here is our situation, we have been BF/GF since 2002 and we started living together January 2010 but then on May of the same year I went overseas for work until March 2013 and in that span of 3 years being overseas I only have 1 month vacation each year so that's 1 month for the year 2010-2011 and another 1 month 2011-2013 of living together and some short vacation around 2 weeks each for every year. I resigned from my work and go back to our place and we lived together from March 28, 2013 to January 20, 2014 so that's nearly 10 months. Unfortunately due to employment commitments I have to flew to CHC on January 21 to report to my work. We have our civil wedding on November 2011 and church wedding June 2012. My question is living together should be straight or it can be counted collectively? Will INZ consider our situation since I'm working overseas. I know we have a genuine and stable relationship but our worries is the 12 months living together requirement. We have a lot of evidences to prove this like joint accounts, joint tenancy agreement, birth certificate of our child, monthly remittance, a lot of photos together and with our families, letter of support from family and friends, utility bills, emails and Skype chats and call logs, letters sent to the same address. Will this evidences suffice for my wife to be granted a resident visa and not partnership based work visa? Hope someone can give me some insights on this and if somebody here who are in similar situation with me, please share your thoughts.

I would send In docs ect of when you lived together. When relationship started ect anything you can. Then submit a personal statement as to why you weren't living together then past few years.
