Default Working while partner has TWP

Hi everyone

Just wanted to know something. If we go over on the strength of hubby's TWP I know it says I can't work. Are you allowed to set up a business (ie me set one up?).

I'd like to think I could help bring some money in if money is tighter over there. I am talking something like an ironing or a cleaning business. I am a qualified counsellor but I need to sit exams before they will let me practise so that will be on hold for a while.

Thanks

Are you sure about this? It depends on the kind of work the TWP holder is doing, but if it is managerial, technical, or skilled trades the spouse of a TWP can usually get an open work permit.

That said, no. If you do not have a work permit you cannot legitimately set up a business or be self-employed.

Spouses of TWP holders working in a NOC 0, A or B job can have an open work permit.

Hi thanks for that.

Can I apply for it after we get there? or would it have to be put in at the same time as his app for TWP?

Thanks oh fountains of knowledge!

Either - you can apply for it at the same time, when you arrive at POE, or at any point afterwards. Probably easiest to just do it at the same time you get the TWP though.

Can't remember what your husband does, but as said above, assuming the job is Skill Level A, O or B (or if a truck driver, heading for AB), then you could get the SOWP.

He's an IT Manager

Do you get the SOWP automatically? Thanks

Ah yes, that's it. Just couldn't remember.

No, you don't get it automatically, you do need to apply for it - presumably you'd apply for the TWP at POE, so would just ask for it then. It's another $150 and would be for the same duration as his TWP.

If my wife is not entitled to an open work permit, can she still do voluntary work? There would be no remuneration for this.

Depends - sorry, vague answer I know! It needs to be true voluntary work i.e. something that no Canadian would be paid to do either, and she cannot get anything from it, even work experience.

HTH.

You ask immigration for it when they process your partners TWP at POW (but you can also get it later if you can through after your spouse). Its the same price ($150) and valid for the same period as the main TWP. It is renewed in the same way as the TWP. It will restrict you (from memory, no medical, teaching, childcare jobs) but otherwise its a lot less restrive than the main TWP which is tied to a specific job with a specific company - good luck!

Think maybe you meant to reply to the OP? As I'm sure that's pretty much what I said!

And teaching/childcare/medical related jobs can be done on a SOWP, it's just that they cannot be done without a medical, but that's easy enough to sort.
