Working visa/immigration with police record
Hi All,
I am mid-twenties civil engineer currently working in the UK, I completed my degree and I have been in industry for three years. I was arrested and charged with ABH and released with No Further Action (NFA) just over five years ago. I did not receive a caution/fine etc. and I have not been convicted of any crime.
I have been interested in a working visa or immigration to Canada for a number of years and I have been looking into the details for a several weeks. I believe that the offence that I was arrested for has a maximum sentence of 10 years in Canada (conviction on indictment), therefore it would not be possible to be 'deemed rehabilitated'. However, I am unsure about whether the rehabilitation period only applies to convictions and admissions of guilt.
I can find no guidance for if an arrest occurred that did not result in conviction/caution/fine etc. Does anyone have any experience with this or has anyone been in a similar position and could advise as to what to expect from the visa/immigration process?
Any assistance would be greatly appreciated.

You have to be CONVICTED of an offence to become inadmissible. Depending on which way you apply for a work permit if eligible you may have to answer the question have you ever been arrested, charged or convicted of any offence.
The answer would be yes but due to no conviction you would not be found inadmissible providing there is a disposition on record i.e. No Further Action, charges withdrawn etc etc.

Thanks for the reply, Lancastrian. I wanted to check this before I got my hopes up or made too many plans for the future. I will certainly be looking into this a lot more in the coming months.
