Hi

After waiting 2 yrs for skilled app to be dealt with, got bored waiting so starting looking for jobs to get in quicker.
I have now been offered a job & got job offer & LMO, so now need a working visa. I have been told mixed messages about how to get the visa due to me having a criminal conviction for GBH in 1996 and serving a 3 month prison sentence (I was only 19 by the way)

Does anyone know if i can apply for the visa at the border, we go next wed for a weeks holiday and dont know whether to try or just continue with our lawyer. I have my police checks (reccently obtained) and certificate of conviction. Also can show since then i have not been in anymore trouble: have since married, had children, been back to college and retrained as an electrician, certificates to prove it.

Our lawyer said not too as if they refuse i will not be able to enter for my holiday, however, my new employer rang and spoke to an immigration officer who said it is fine, just explain we are there for holiday but want to apply for work visa if possible while there.

If anyone can shed any light on this, i will be enternally grateful.

because the conviction was around 12 years ago wouldnt you be deamed as been rehabilatated i would have thought.hopefully someone else can tell you better just a thought and good luck

hi

you would have hoped so but by what i have read, apparently not. As it was for GBH and will always show on his file, time does not prove rehabilitated, you still have to prove it. Im hoping luck is on our side, we have been waiting for the skilled visa since april 06, and they are currently only processing the ones sent in july 05

depending on what job you both do you may not need a police check so you could possible get a twp at port of entry

I am a financial advisor here, although its not me that has the job offer it is my husband, he is an Electrician. We have got the police checks done, received back this week

i am a carpenter and on cic website it states that for construction you have to have police checks which you have had done.i think it is down to the immigration officer as to if they will give you the visa.you are probably better off applying at chc in london.or contact andrew miller on this site as he is an immigration specialist you can pm him

IF the OP was convicted of GBH, it is usually equated to Assault Causing Bodily Harm under the Criminal Code. The punishment is up to 10 years. If this how CHC views it, it doesn't matter how much time has passed the OP has to apply for rehabilitation.
