Work Permit Refused.

Default Work Permit Refused.

Our application for a new WP has been refused on the grounds that our Employer needs to submit a new LMO.

When we have our new LMO we have to submit a new application to extend our WP, as well as an application to Restore our status here. This is currently taking 73 days - on top of however long it takes to get a new LMO.

Do you know if, once we have our new LMO, can drive to St Stephen and flag pole it? Or is this not possible when restoring your status?

Hi Amy,
I have had a dig around but I cannot find anything that says if you can POE and restore status?
Not sure what else to suggest.......Can you ring CIC?

Why do you need new LMO??

I have absolutely no idea why we need a new LMO. They won't tell me - they just keep saying we need one!

Aren't LMO's required for new work permit applications/work permit extensions? I suppose it depends on the job. I know that we will have to submit a new LMO with our application. The new process for LMO applications is a little longer now too. It's 2 weeks advertising and 3 months before they can submit LMO application! You can do concurrent processing of TWP after the LMO application has been submitted by the employer.

My LMO in New Brunswick took my future employer 7 days. Shouldnt think it would take that much longer in NS

When we went to Buffalo last month to get new WP we did not need new LMO, OH's LMO does not expire until March 2010.

They've changed the advertising periods for LMO applications and when the employer can apply for the LMO.

Advertisement and Recruitment

Most occupations (exceptions) are subject to the same minimum advertisement requirements based on the National Occupational Classification (NOC) system, skills levels O, A, B, C and D. Failure to comply with the requirements outlined below will result in the application for a Labour Market Opinion (LMO) being denied.

You will have conducted the minimum advertising efforts required if you:

* Advertise on the Government of Canada national Job Bank (or the equivalent in Saskatchewan, Quebec or the Northwest Territories) for a minimum of fourteen (14) calendar days during the three (3) months prior to applying for a LMO.

The advertisement must include the employer's name, business address and wage ranges being offered.
