Wife w. Visitor Visa Returning to Canada for PR Sponsership.

Angry Wife w. Visitor Visa Returning to Canada for PR Sponsership.

Dear Mr. Miller.

I have several short questions that need to be addressed if possible. My wife & I have been going through a problematic dilema since the begining of our entire ordeal.

3 Months ago my wife and I where married in the Federal Republic of Brazil. I am of Canadian Citizen and my wife is a Brazilian Citizen. We did plenty of research to the best of our means on the internet about the sponsership process and what would be the best route for my wife to return back to Canada with me.

6 months ago we called the Consulate of Canada, and they informed us that the best route seeing that my wife has already a Canadian Visitor VISA would be to get married in Brazil and then for her to return home with me. I found it odd that they would have made such a remark as she would be required to obtain a new Passport & VISA.. The Immigration officer said that wouldn´t be a problem.

Our intensions are as follows, My wife & I to return to Canada to legalize our marriage, Also if I receive a job offer which is very doubtful, that I may work for 3-4 more years to pay off a growing student loan. Rather then working here.. Then after to return back to Brazil to live permanenteny.. However Brazilian law requires the marraige to be legalized in Canada so that my wife may sponser me.

We got so much misinformation from the consulate, they informed us that we would need to get married all over again in Canada and that everything we we´re told was incorrect.

I contacted the Register General of Canada and City Hall from my home city and they informed me that, the consulate had misinformed us. That it would require a translation of our marriage cert. a consularization and as long as the marriage cert. has a leal seal. Which is does. Then our marrige would need to apply for a marraige cert.

To make a long story short, since the begining the consulate here has been giving incorrect information, whenever before giving our names or information the operators frequently disconnects calls, they are rude treate inquires with little help. And they always put you on hold hour hours.

1. Is there anywhere that I can complain regarding the treatement that these employees dish out to Canadian Citizens and Forieners?

Next, When my wife and I returned to the Office later on that afternoon, We we´re asked to sit down and wait to be interviewed. They interogated the hell out of us, our responses at that time where simple. And that we had only the intensions of returning as Visitors and then to return back to Brazil. I had not put the consideration into thought that I would sponser her yet as I was unsure about a job offer that I may or may not get.

Eventually in the end my wife got a Visitor´s Visa.. I received my job acceptance letter and now we are waiting another 4 months before I am to begin with my new job in Canada.

1. However we face the problem with my wife being denied enterace from Immigration on the grounds that we first applied for a VISA for visitor purposed only. What would be better for us todo? Take our chances and explain our situation to Immigration when we arrive? If denied then take the change for my wife to apply for a Ministers Permit? Or wait the 8months-12 months for to receive an Immigration Visa to enter Canada by myself applying from within Canada?

2. We are weighing the possibilities. I am ready to return to Immigration with proof of funds, employement, proof of our marriage as well as some of the misleading information the Consulate has provided and told us.

3. Finally the Clerk at the VISA Office was not only the main problem, When I went to speak with the Consular myself regarding our marriage legalization I was provided wrong inaccurate information which she confirmed 3 times with her sources that it was correct. Which the Register General and City Hall say is incorrect and un-nessary. I have a letter from the Consulat explaining what they have said. next I will obtain one from City Hall in my home town and from a friend from the Business & Consumer Affairs center in Toronto Explaing what they have told us.

This is a huge mess.. I hope you are able to shed some light on our sitatuion

From what you described the mess is probably caused by you, although I don't
see at this moment any major problems.

As your wife has valid visitor visa you should just come back to Canada with
her and during the customs/immigration clearing process at the airport make
sure to honestly disclose your intentions to start sponsorship process from
within Canada. You should be fine - just don't make more mess by trying to
trick the system...
