Default Visitor's Visa

Hi all,

I am now in process of PR. My interview was waived and my medical and Fingerprints
for RCMP have been submitted in late June. I have not heard anything from them
since then.

My Visitor's status has expired on September 1st and I applied its extension about a
month ago. Today I got a letter from Case Process Center saying that my application
has been forwarded to Local Immigration Office. And They will provide the further
instruction regarding this case.

Is this a normal procedure?? Or this is something I need to concern.

I have been extended my Visitor's status twice and this is the first time I am
getting this kind of letter. This is a new process since the regulation change??

I hope to know what kind of possible situation I am in.

Hi Mr.Miller,

Thank you for your reply. However, what does look like I will be?? I need to concern
or I will be okay. I am not quite sure what you meant by this sentence.

Is your case an inland application? If yes then you will be going through the
interview (just a formality) and landing process in the local CIC office.

No, my applicatin is not inland. It is Independent application submitted to Buffalo
in July 2001. So, I am not sure that the landing process will actually take place at
this time because my application is Independent.

Are you on student permit here? If yes then it may be interview/landing as well as
new law created in Canada landing class for those on student permits.

If not then you will most likely have some serious explaining to do why are you
remaining in Canada as a visitor for so long, what are your financial sources to
afford it without being able to work, etc.

Dear Mr.Miller,

Again thanks for your reply.

When I applied, I was on student visa. But my visa expired during the process. So, I
changed my status once to visitor's status and extended it once.

I have some saving available which I saved up when I was working before I come to
Canada. I am simply waiting for my application to finalized at this moment.
Originally, I was hoping that my process will be completed by now. But it has not
happened yet.

Dear Mr. Miller,

Please could you clarify something that you wrote previously? Re Below.

I have just applied for a student visa from Canada. I am currently on a tourist visa and have applied to change this status through Seattle as I have been accepted on a course of study.

Once the student visa is finalised I want to apply for PR. I was assuming that I would have to apply outside of Canada, in the US or elsewhere, but now you make mention of 'new law created in Canada landing class for those on student permits'. What exactly do you mean by this?

I would be grateful if you would explain what you meant as whilst I have no doubt that you are a well informed person, I have noticed that quite often you make statements in this NG without backing it up with substantiating evidence!

Immigration Manual is not yet fully published, so I can't really tell you for
sure if, when and how in-Canada landing for holders of student and work permits
will work. Announced (during the consultation of Regulations process) intention
of CIC was to develop similar in-Canada landing process as it is in the case of
people who's cases are processed from within Canada (for example sponsored
spouses within Canada) - but it was never even discussed to allow student
permit holders to apply for PR visa within Canada. It is only about landing
process, not about application process and not about where application should
be submitted.
