Visitor Status extension
 

My cousin is presently in Canada. She originally entered Canada as a
Visitor (being Mexican, she does not require a Temporary Resident Visa
TRV) and because she enrolled into a couple of General Interest
Courses at an Art school, she was given a Visitor Record at the port
of entry that allowed her to do so and valid until January 2003.
Now she wants to extend her visitor status to enroll into the same
courses during the spring and summer terms (courses last less than 6
months and less than 15 hours per week).

I just want to make sure we are following the right procedure for her
extension.
She should fill up form IMM1249 "Application to change conditions or
to extend my stay in Canada". However, I am a little confused with
this form, as it mentions "Temporary Resident Status" ($75 fee). Is
this the same as "Visitor Record"?
I am getting confused between "Temporary Resident Status", "Temporary
Resident Permit" and "Visitor Record".

Can any of the experts confirm that in her situation, to extend her
stay in Canada as a visitor, she must fill IMM 1249 (as noted above),
pay $75 fee and mail it to Vegreville?

The submission of the IMM-1249 application form along with a fee of CAD
$75 to the CPC in Vegreville is the proper procedure in this case. The
temporary resident permit and visitor record refer to the same document.

Mr. Cohen may be quilty of misinformation if she is palnning on taking
another course. See 188(1)c of the regulations. The exemption from a
SP only applies for period of their stay authorized upon entry to
Canada. It would appear that extension received in Canada are not
included. I practical terms the regulations was not designed to allow
a perosn to take a series of short courses as you contemplate.

So what would you suggest my cousin can do:

1. Use form IMM1249 to change conditions and apply for a study permit,
even if the courses she will take are less than 6 months and 15 hours
per week? (she can include in her application a letter from the school
stating the duration of the general interest courses -painting-)
2. Use form IMM1249 to extend her stay as a visitor without mentioning
that she will take the courses?

When she originally entered Canada, the immigration officer at port of
entry gave her a Visitor Record that specifies the courses she will
take and the length of such. Immigration is aware that she is taking
such courses. The officer even mentioned that he was giving her the
"Visitor Record" so she could extend her stay if she wanted to do
so.....

How would you recommend my cousin to proceed? visitor extension or
study permit, or some other option?
