VISITOR EXTENSION & OUTLAND APPLICANT

Default VISITOR EXTENSION & OUTLAND APPLICANT

Hi I am a canadian citizen UK born. My partner is from the UK. We entered canada last july for an extended holiday and to see if my partner likes it here. We applied to extend his 6 month stay here in December (1 month before that current one expired). We asked for a further 6 months or longer taking us till at least the end of July again.

We have heard back from CIC (last communication February) saying it has been forwarded to another office but heard nothing as yet. No one has said he can or cannot stay as of yet. We have also done an outland application whilst here with me sponsoring him.

I am right in assuming that until CIC officially give you the ok or ask you to leave you can stay on? Reason for worrying is we are hoping our outland application goes through quickly (have been approved as sponsor May 11th and now paperwork in london May 24th).

We are afraid that they will request his passport from the London office and we don't want to break any rules. Do we apply for another extension even though we haven't officially had a decision on the last one?

Very confusing!! anyone had the same experience.

this is my worry actually, mine ran out in April - I applied for an extension, but I was thinking that if I hadn't heard anything by October (the time the extension should run out if one was granted from the April ) then maybe I should apply for a new one.

But how can you apply for an extension to a visa that you don't even know you've got yet????

I applied for an extension in December and likewise was worried my time would run out. I called CIC and was advised that as long as your extention request was sent on time or no more than 90 days over your visitor expiry date (depending on how you applied) you will be on Implied Status and can remain in the country until you have had either confirmation or rejection. The current time for processing is something like 146 days for an extention to visitor visa!! Therefore it seems you are okay. With regards to it crossing over with your sponsorship, maybe that is the reason the visitor visa is passed on to another office? They will surely know the history of your request to extend when processing the sponsorship......Well I would hope!!!!

Hi thanks for your response. I know it's totally confusing, but that is canada for you. So long as we don't break any rules. cheers

hi thanks for the reply. I guess if its 46 days we may hear soon as he applied early december. I guess we will try to extend again when it eventually comes. Maybe they know or don't know about the application. We hadn't applied when he sent in his extension, we applied 4 months later. We just said he wanted to extend as he was finding out whether he would like to live here for considering sponsorship by myself. I think they are so busy in these offices i would be suprised if they are joined up. Don't know what we would say for the next extension. Any ideas?
