TWP duration

Default TWP duration

Just a couple of questions.

Is it the officer at POE that determines the length of time of a TWP?
What is the maximum time that can be awarded?

Normally TWPs are issued under several different categories. I have issued TWPs for 1 day and up to 3 years in duration.
If being issued under an LMO the LMO will state length of duration.
Other classes have a maximum amount of time assigned to them as per section 11 page 97, 98 & 99 of this manual

A work permit will only be issued if the passport validity covers the length of the TWP eg if you have a 2 year contract but passport is only valid for 1 year then TWP will only be issued for 1 year unless exempt a passport.

so I realise the duration is determined by the LMO.
On the LMO application my employer wishes to tick the temporary offer with intent to make permanent so was wondering what he should put down for the expected duration of employment. I am NOC O or A so can he put 3 years?

•The LMO duration date is based on HRSDC/Service Canada’s assessment of an application for a LMO. It identifies the recommended length of time that a work permit could be issued to a foreign worker without negatively impacting the Canadian labour market.
•The work permit expiry date is determined by CIC when a foreign worker applies for a work permit. It indicates how long a worker will be allowed to reside and work in Canada.

OH's LMO said 3 years but at POE he only got a 1 year TWP, apparently because work put a 1 year probation in his contract.
